As much as I'd like to see you succeed with that, if they're out of cash you can win and get absolutely nothing for the trouble. I have a feeling they may be filing some flavor of bankruptcy eventually, so any judgment you get would be way down the list of people who have a claim on remaining assets. (I am NOT a bankruptcy attorney of any type, but I did stay at a Holiday Inn last night)
I mean, it takes them 6 weeks to send guys a $7k refund. Can you imagine if they got hit with a $50k judgement?
