Yeah, this is kind of like the checklist of things not to do when you get in an accident and/or have body work done. OP, your best bet is to keep after the body shop until it's right.

i called the liberty mutual few times they always said their system is down can't put my imformation out and i call today to claim the diminish value and he told me the adjuster is not here they will call me back at friday.... i feel like they rip me off since i dont have any experience of this situation...

they sent me a check for 760 dollars so now i payed 600 for the body shop(my friend told me to go there). worst part is the body shop took the cash and they never give me any paper work. anyway the bumper is fixex and look great just the color is slightly different.
all i wanna do is claim the diminish value and see how much money i can get i may use that money to find a better body shop to repaint my rear bumper

I hate to say it, but I think you may have screwed yourself every step of the way. For future reference, remember the following:
  • Let your insurance deal with their insurance
  • File a police report
  • Get several estimates and submit the priciest one
  • Cheap body work is cheap for a reason
  • Get a reciept and keep a paper trail

If your insurance charges you a deductible for an accident that is not your fault, you should dump them immediately. i should have ask more information before i sent my car to the body shop
i accepted the first quoted from the insurance that's why is so freaking lowball but at the moment i just wanna fix my car asap. because i got hit by the every same day i bought it... so freaking unlucky omg.

do any body have any experience for the diminish claim before?

I don't know how it works in your state, but in many places you have to sue for diminished value, and that may cost more than you'd win.

everytime i called that guy insurance they always put me on hold for a long time. i called my insurance(geico) once and they told me i should call the other guy insurance better........ they giving me a headache

Wow... if my insurance company gave me that response, I would tell them to go fvck themselves. It's their job to take care of my claim. I should clarify that I am assuming you have full coverage (liability AND collision).

sounds like i got screwed now........ i called the body shop their not going to repaint my bumper because they said it meet their standard .......

my only hope is to claim the diminish value and get the money to repaint it at other body shop.

worse day of my life omfg. i hate to deal with the insurance they always put me on hold for long time.

yes i have full coverage but my insurance said since not my fault i should deal with the at fault party insurance better..... because i never been in a car accident before dont know what to do i'm feeling so frustrated.

That's just poor service from your insurance company IMO. I guess that's the kind of service to expect from Geico

Well, it looks there is a lot you can learn from this experience. There is definitely some good info in this thread, and you can find out other good info with a simple Google search. Since it's legal in Texas, I use video and audio recording to document the accident as soon as it happens. I hope you get the car taken care of or at least get a few extra bucks for your troubles. One time when my wife was in an accident, she called me and said the guy didn't have his insurance information. Luckily, I was already on my way home and not far - I told her to make him wait around for me. I tried to call the cops on my way to file a police report, but being 5 pm they were tied up elsewhere. When I got there and chatted with the guy, he made it seem like he had insurance but was from out of town, so he just didn't have it with him. I told him he was going to have to talk with my insurance company before he could leave the scene if he couldn't provide the details I needed and since there was no cop coming. I called Nationwide on the spot and explained to them what happened very briefly. I got the guy to admit full responsibility on the phone, and we parted ways. Sure enough, when Nationwide called me back later that evening to get my full statement, they said he did not have any insurance at all and had already called back to retract his statement. They said not to worry and took care of everything without needing anything else from me. I had the vehicle repaired that same week. That is what an insurance company is supposed to do for you.

And note to self: never admit fault at the scene if you're in an accident. Let the insurance company deal with it.

Your situation sucks, but lets not get too melodramatic. The bumper of your car isn't quite the right color. That's not quite the worst day of someone's life. I hate to say it, but I think you've painted yourself into a corner. Either pony up out of pocket to get the paint matched at a better body shop, or learn to live with the mismatch. You may have made too many mistakes to come back from on this one. Keep calling your insurance. You pay them to handle this stuff for you. Maybe you get a better resolution.

Just wanted to clear some things up...

If you file a claim against your own insurance, you do have to pay your collision deductible (it's in the policy wording). It can be waived up front or refunded on the back end because of the subrogation potential, it's just up to the individual adjuster handling your claim. Also keep in mind when you claim against your own insurance, it shows up in your loss history whether or not your company was able to fully re-coup their losses from the other company. If they don't fully recoup, the difference will show up as a loss paid to you instead of $0. Either way it's still there. This may or may not adversely affect your premium at renewal or if you choose to shop your insurance, again it just depends on the company.

To the OP- sounds like you did work with a shady shop. Any reputable shop would stand behind their work. Sucks, but at the end of the day lawyering up will cost you more than it's worth. You'll have to live with it, or buck up and pay out of pocket to a GOOD job that will properly blend the new paint with the old for a seamless transition. If you've already taken the check from the Company, then you are SOL. Calling the the other person's company will do no good as they'll just tell you to go to the shop for repairs. Rule of thumb, NEVER take the check until the settlement is to your standards. A lot of times by taking the check, you're agreeing to the settlement. There are extenuating circumstances, but for a claim this small, I highly doubt they're going to re-open to give you diminished value.

Lastly, Geico sucks, so it doesn't surprise me they told you to call the other company.
