OK Semtex that was pretty funny, i needed that, good laugh for sure. Just to give you all an update, i went to the appraiser and he is filing the papers with the Nissan dealership,which i have heard does incredible body/pain work, i dont think you can go wrong with having the dealership do it. My insurance company just has to approve it, so i have to wait and see at this point. ALSO, i will be hiring a LAWYER to review whether or not to sue her for diminished value or loss of value. So i will keep you all posted on that AND POST "AFTER" pics

I called the dealership today and told them what happened and they are very saddened and pissed. This was the only one they sold, so they are not happy

Glad you got a laugh out of it, man. Diminished value is typically paid by the other driver's insurance company, assuming the other driver was at fault (which she obviously was in your case). Point is, you shouldn't need to sue to get DV.

Hey, thanks for responding. I have a witness who saw her backing into the side of me, so i am hoping this can resolve any issues. I also did file a police report. Another question I had, was whether it was worth it. I went to the appraiser yesterday and he is suggesting the side door to be painted, the rear panel to be buffed from dents and painted, a brand new bumper, and also a new tire/rim in the driver rear side. He said most people that make a claim for loss of value have a car with major damage, so im not sure if I should take his word.

I think at the very least I will make a claim with her insurance company. Do i make the claim now or after the work is done on the car?

So she did it on purposing?!? I frickin knew it! Have her thrown in jail and tow the car to the middle of nowhere and have at it with a machine gun.

oh man. i just read this whole thread. my condolences. perhaps you can get that fixed, an unload it quickly, then get another one. if you want an undamaged car, and can find one. an anniversary vehicle. of all the cars in the parking lot...really? damn!

that said, there are paint shops out there that can spray better than factory. i remember sending out an 88 RX-7, black, for a hood replacement and paint. the hood looked like glass. it was so nice, we had to send the car back so they could wetsand the rest of the damn car to match the new hood's finish.

but prep and knowledge of the paint and the gun are critical. find a shop known for working on Porsches if you have to. those people are picky as all hell.

meanwhile, i registered today specifically to give you this advice, as i work for an ins. co.

file your claim with THEIR insurance co. if you file with yours, they will want your deductible up front. then they will subrogate to retrieve it for you, later. also, going through their insurance company as a claimant gets you a rental car a lot faster, and without expense to you. your rental coverage usually only pays a percentage, if you have it.

additionally, with regard to DIMINISHED VALUE: that is determined AFTER the repairs, and is also paid by the other party's ins. an appraiser comes out to see the car and records shortcomings in the repair, if there are any. the ins. co. then evaluates the mileage, significance of impact, cost of repair, and value of the vehicle. don't expect to get much more than $1k. it really isn't fair at all. but what the hell in life is. good luck, man.

and from now on, park in the last spot, closest to the curb, and tie a pitbull to the bumper. damn non-driving s.o.b's. THIS IS WHY I PLAN TO RHINO-LINE MY ENTIRE TRUCK THIS SUMMER. ding that, kcufers!

I have a family member going through this right now. Rear ended with less than 100 miles and 5k worth of damage at least. I called my friend who owns their own insurance co, who I have mine through. She said that back around 2003 someone tried to get DM from Commerce insurance and failed. The Mass courts denied it and since then it's been put on the books in Mass that no insurance co has to pay out for DM. Do a Goggle search and you can read the entire court case and decision. Many other states, DC,NC and others down south have started paying DM claims but it won't be easy here in Mass. You will 100% need a lawyer. I hope you have some luck but I think you're going to really have a battle on your hands. My family member is still waiting for their car to finish being repaired. He wants to trade it in asap after it's done and the dealer said it would be a 5500.00 loss to replace the car. It was not a sports car, but his first ever new car and he is devastated. I probably shouldn't give too many details about the case since he is still in the process of doing the claim.

Please keep us up to date on how it goes so and i'll let you know if he has any luck. Perhaps we can help each other out. I think it's time Mass gets with the program and acknowledges these claims. If it was me, i'd be fighting this to the end with a lawyer. Even if I only got a little money, I'd be more hoping to change the law so they have to pay DM for everyone in the future.

And sorry about your 40th, I really love the color combo inside and out. I'm sure a good body shop will make it look great again, just be picky, if something isn't perfect, don't accept the car until it is! And you just can't win anymore when it comes to where we park. I've always park a mile away from the masses, in a corner spot, etc. It's great until a group of teenagers sees it there, all alone, no people watching them, and they key the entire side.. Not on my Z, but my Maroon Titan. We're screwed no matter what.

Most of the security cameras are going to be focused on the closer parking spots, in which case, a detective can pretty easily tell who did it, if they went in the store and bought anything.
