For a while now a lot of states didn't allow you to pass emissions with a emissions sensor disabled. NJ I know first hand, mini cats work, and are very inexpensive now days. Prosport has one and I've used bigdaddiesgarage.com and they worked.
This is something more along the lines that Husam/Seb/Eugene/etc. should answer, but from my take: It's not only the O2 sensors, it's also the Evap and possibly the modification of the "OBD tables outside of OEM min/max parameters" (or whatever it says) that could potentially seriously limit the ability of a tuner to tune a vehicle, especially a boosted one.
