Sorry to hear about getting hit. Good your are safe, mostly cosmetic damage, the lady did not die on you, and you have an opportunity for an upgrade to a nice kit, new set of wheels, etc.

Truth be told, it is an age thing --- young and older. I agree to a certain extent with Z370Z011. Once you get past 70, you become dangerous but not as dangerous when you were a teen.

According to statistics from the National Highway Traffic Safety Administration and the Insurance Institute for Highway Safety, the safest drivers are in the age group between 64 and 69 years old. After 70, it starts to rise ---- sorry Snowhite370 -- you're a victim of a sad but true statistic....And studies of the data reveal that teenage drivers — especially male teenage drivers — are the most dangerous drivers on the road.

Ahhh, better edit this post. Speed limit of 35 means no more than 35. You're admitting to exceeding the speed limit.

In our state a speed limit of 35 = you can drive 35 mph +/- 5 mph due to speedometer calibration. In my Z, going 50 mph, on a radar gun is actually 47/48 mph.

In Illinois you only get a ticket for 41 or more in a 35 or a 29 or less in a 35.

ZMan8, even in my state, while our state statutes say, nothing in excess of the speed limit. Prior court cases here have allowed people to get off of speeding charges unless they were 6 miles above the posted speed limit. Basically the same as Illinois. This is not to say they weren't speeding, but that they do not have to pay the fines associated with speeding, thanks to the court.

In OP's post below, he is admitting to exceeding the speed limit. Plus his comment in the 2nd sentence, I know he's joking, but it wouldn't look good in court. In a civil case where Preponderence of Evidence (just got to tip the scale in your favor) is the burden of proof, this may prove to be the reversal of his claim that the woman was at fault. If you or I were the woman's attorney, I think we would both do the same thing.

I don't know how to post the link here, but the Illinois State Statute on speeding is basically the same definition as Hawaii. So while we may not have to pay a ticket for a few miles over, it's just good to be cautious what we post on the internet.

There's really nothing you can do about old people. Enact all the laws you want, they'll just do what they do. If I was 90 and someone told me I couldn't drive, I think I'd basically say "screw you" and drive anyways. What are they gonna do? Throw you in jail for the remaining 3 years of your life? Fine you or sue you? Just have a lawyer push those dates out for a few years...

Yeah it sucks. I bet the elderly secretly think its the youngins responsibility to bring up the average reaction time and visual acuity when it comes to encounters with them. We'll probably secretly think that way when we're elderly too.
