That's a good question....according to my insurance company, yes....according to Fairfax County police, no. I was never sited for the accident nor was a ticket given.

However, just this past saturday I came home to a letter from my insurance company....the driver has gotten himself an attorney so we'll see how things go from here.

Sigh....I know exactly how that feels. I hoped the same thing when I woke up the next morning but when I looked down and saw the cast on my left foot....I knew it was all too real. And yes, my rates went up....and yes, I got full replacement value on the yellow Z.

Hope things turn out for the best for you!

Well if you are going to be sued at least you did actually hit someone. I am currently being sued by 3 punks that I never actually hit. It was a trap at a light in a bad neighborhood in East Baltimore. I was in my Cadillac behind their 92 Buick Skylark bucket. The driver jumps out and starts saying I hit him. I was like no way, got out to check for damage. There was none, but he started claiming he had injuries and tried to get me to give him cash. I called the police, and of course he denied extorting me. He started saying he wanted an ambulance and then changed his mind. The police told him he had 36 hours to go to the hospital. Unfortunately the Baltimore City police are lazy as hell and wouldn't do a report or any investigation. If they would have done that they would have found that he was driving on a provisional license in a car not registered to his name and with no insurance. There was also a baby in the car and no car seat. The cops knew he was scamming me. They told me that, but they did nothing. They could have cited him for numerous things. Now the driver and 2 passengers are suing me. I guess the baby is too young to fake injuries. A week later a girl in a Nissan Versa slammed into the back of me at a stop light. It was then that I decided the Caddy was cursed and I went and got a Z.

I was watching on news recently about how insurance co's thoroughly investigate claims now, especially when the economy is bad. The insurance co's are tightening their belts not only because the economy sucks, but because lots of people who live above their means i.e. buy cars more expensive than their budgets dictate are burning them, claiming false "stolen reports," etc.

You can spend a lot of time in jail if you're caught making a fraudulent or rigged claim. I'm not the "ethics police," but exploiting the system doesn't work nowhere as easy as when our economy wasn't outta whack.

Well my insurance company did take a ton of photos of my car to show that there was no damage, but I am sure they will be offered some sort of settlement. These ambulance chasers perpetuate the situation. About 8 years ago I was in an accident in my Maxima. A woman cut me off coming out of a parking lot. I had real bad whiplash, so after seeking treatment I went to an attorney. I was told by the hospital to follow up with physical therapy, but the attorney recommended someone. I went one time and it was a joke. The waiting room was filled with deadbeats. The "therapist" gave me one of those electric pulse things to take home and put on my neck. They wanted me to come every day for 3 months. I told them I had a job and that was out of the question. They told me point blank that if I didn't go that I wouldn't get much of a settlement. I couldn't do it. It wasn't right. I ended up getting about 300 bucks after the doctors and attorney was paid, and I had a 1 year old Maxima with frame damage. The attorney was pissed that I wouldn't play the game. In this recent accident, where a girl that didn't speak any english rear ended my 6 month old Cadillac CTS, I filed a diminished value claim on my own. I used that settlement to pay the balance in my loan after the trade in to get my Z.

u should tell them it's totaled cuz the bumper frame is damaged/bent/curled on the bottom passenger side corner. thell them u don't feel safe driving something with a damaged frame

I was rear ended January of last year. She was probably doing 20-30 mph. I got out of the car and was walking around fine. I had so much adrenalin running through me, I didn't think I was injured. Once the adrenalin wore off and I calmed down, it was a whole different story. I had four dislocated ribs, double whiplash, two torn shoulders, and many other injuries. I am just now finishing up physical therapy on my left shoulder, and I still have chronic back and neck pain.

My medical bills have far surpassed $40k, which have all been paid by my auto/health insurance and out of my pocket (FL is a no-fault state). Needless to say, I am suing. And her truck looked a lot better than your G.

Instead of calling the guy you hit a baby, maybe you should just man up and take responsibility for possibly ruining the next two years of that guys life.
