Check to see if the hatch unlatches on the first attempt. If not, it needs the springs replaced. There is a TSB out for this.

Check for ECU whine when the car is on. It either happens all of the time or it is intermittent. Either way it's annoying as hell and makes your ears want to bleed. It comes from the kickplate on the passenger side area. If you can't hear it facing straight ahead, usually you will pick it up when you turn your head to the left facing the side mirror.

Check wheels for damage. Check to make sure all of the body panels line up right. Make sure the paint on different panels matches. Just general stuff to make sure it was never in an accident.

Try to drive a brand new one to compare how the two cars drive, just to make sure the '09 is in good working order. Usually I'd recommend a 2010+ because all the first model year issues were worked out.

You can definitely come down on that price.
