As she was at fault, I'm not sure how the law dictates in California, but only her policy should be effected by the occurrence. Therefore I'd go ahead and collect

Yep, and the guy who hit me owned a company. He had ALL his policies with them. Until the end of that day, when he canceled every policy he had with them.

OP depending on how bad it is, you might want to consider taking the cash. i got the smallest nick on my rear fender from a lady that slowly backed into me in a parking lot. I got a quote for $1400 and she paid me in cold hard cash! just buffed it out when i got home and you can barely notice it now lol

Yeah i want to say in Texas if you get hit in a parking lot then you are sol. I want to say back around 2000 a friends mom was hit in her drivers side door by some old lady that couldnt see " the lady was actually waving hello before she ran into her". She was sol and had to file a claim with her insurance to fix it.

Why would you bait him into hitting you? Unless the guy is being a total douche and unwilling to work with you it's best to just be respectful in these situations and hold back the anger you probably feel. It usually works out better that way. Accidents are still just accidents.

sorry but crap like that is why i'm paying through the roof for insurance. if something happened, you just bill insurance for any property damage or physical injuries, and NOTHING ELSE. People like to be smarta$$es and "make friends" with lawyers and chiros and physicians and physiotherapists, and think they'll stick it to the big bad evil insurance companies. Well guess what, insurance companies aren't there to lose money. So as a result of all those bogus claims they have to pay, they end up raising premiums for everyone to recover the costs of being "skewered".

Just have a body shop fix it and have her pay the cash. No point in going through insurance since it doesn't seem the damage is enough to exceed the deductible.
