I have just been through being rear ended myself. Totaled car and 2 herniated disk, one requiring surgery. If the insurance money is not there, you better have uninsured/under-insured motorist.

Sorry to hear that. Not sure how the tort laws work down here, but if this happened in NY, NJ CN or MA, you pretty much hit the lottery.

No amount of money is worth a bad back, but it beats a bad back and no money.

Dude, this isn’t a “slip and fall” PI case that all the ambulance chasers that advertise on late night tv are tripping over each other for...

Again, in NJ there is a state run uninsured motorist pool that EVERYONE pays into. That’s separate from the under/non insured policy you can pay extra for.

If you required surgery, you are entitled to pain and suffering.

Unless you were performing brake checks? JK...

I was on a Jury where a dude was rear ended by a Dr. He went straight to a lawyer after the accident. Didnt see a Dr. for a few days after the accident. Then had tons of therapy with a chiro.
He claimed that he couldnt stand or sit for prolonged periods of time, couldnt play with his kids like he used to, etc. Was suing for 30k+.

He sat on his @ss the whole 3 days of the trial. Showed no discomfort. Needless to say, deliberation was quick, he lost. Awarded him less than 2k.

I’m talking about the people that are legitimalnly injured.

I have no use for the thieves that game the system with slip and falls and chiropractic claims.

Nobody fakes surgery on their neck, and should be compensated for it.
