Dealarship problems anyone know how to resolve?

OP, you got taken for a ride, which alot of it you could have avoided.

1. you never EVER trust a used car salesman.
2. you should never rely on verbal confirmations. you should have requested adamantly for pictures on the specifics you were looking for (i.e. pics of rims for any curb rash).
3. never ever give into the sign/drive gimmic. you're basically buying a car in the blind without knowing anything about it.
4. you should have gotten a pre-approval from your bank, which they would give you a draft which is equivalent to a blank check for up to a certain amount your bank approves you for. i did this and used the verbiage "i can buy this car in cash" and that will give you the upper edge when negotiating.
5. get everything that was agreed upon IN WRITING. verbal confirmations, again, means nothing.
6. even if you have multiple inquiries on your credit, if it is done at one time, it shouldn't have taken that big of a hit on your credit.
7. buying a car, new or used, is like playing poker. you never show your cards and in your case, it seems like you really wanted the car, which is fine, but don't let the dealer know that. make them think that you can walk out at anytime and that you could go to another dealer to do business.

i was in the market for a 370Z for a while, and when i was seriously looking, it took me 8 months to find mine. i made many long trips, spent countless hours, walked out of many dealerships after giving them the middle finger, etc., but when I found the right one, it was worth the wait.

I wouldn't just throw in the towel regarding your own lawyer vs. arbitration. I think that arbitration baloney refers to a new car warranty and failure of the mfr./dealer to live up to their responsibilities.
Ask your family, friends, relatives, etc. if they can steer you to a trusted attorney that you can run this situation by. Print out your story that you posted here, and summarize each paragraph with handwritten notes in the margins so the lawyer doesn't have to agonize over each and every paragraph looking for that one magic bullet that might save the day for you. This will help him remember the important stuff after you leave his office after having met with him.

Yes, you might risk losing another $100-200 just to meet with him (FIND OUT JUST HOW MUCH BEFORE YOU AGREE TO MEET WITH HIM), but this might turn out to be the best post-sale money you have spent so far. You might get lucky and he might charge you less or even zero for the first meeting. You might get super lucky and have him instill so much fear in the dealer that he will convince them that the very best thing for them to do is to buy back the car and make you whole again.

As an example, a lawyer may look at things like this: "I have been told at Nissan local dealer of and Chris Myers that it should not have passed the CPO inspection due to the aesthetics not even including the functionality problems with the clutch and rattle." as some failure of the dealer to deliver the product as described. I'm stopping short of suggesting even more severe claim against the dealer because I'm not a lawyer and I don't know the law. But I have had a lawyer in the past scare the you know what out of a dealer into returning my money for something he did not deliver as promised, despite all the legalese this dealer tried to hide behind. So don't let them just bully yiu around . At least put up some sort of a fight.

Even in this day and age a lot of dealerships earn the stealership name. Sucks for sure. Hope you get it all sorted out.

Can I ask if this was your first dealing with a dealer?...I have since 1976 bought brand new cars and have learned to step away when I get BS, simple. My stepdaughter bought a car via internet and we both drove to FL to see the car which we did not get it but were able to negociate a price lower from another dealer down the road on a similar car. Can I ask your age, because if you're young/ female or a foreigner they will take advantage of you, dealer scumbags tactics, sorry to read such case, good luck lawyer yp and call the BBB
