McD's is a huge corporation and has been around for a long time, and has probably seen many stupid lawsuits come through. I'm sure they have a counsel department with some top-dog attorneys.

At the end of the day, the burden of proof is on the plaintiff. If I was a judge presiding over a case like this, I'd throw it out in a heartbeat and tell the plaintiff to go pound sand. This is just an absolute waste of time and resources.
