no matter what decision they make you have the right to appeal their decision. the best thing you can do right now is to have pictures, document all conversations, and force them to do their job while trying to stay calm. Insurance companies get paid by how long they can delay or not pay a claim. Also when you talk to them ask for a supervisor and finish every conversation with having them to give you a followup phone call by a certain day/time as well as any inspections they need to do and ensure in is in a time frame you are happy with. Once they realize that you have your ducks in a row and are willing to hire an attorney they change their minds pretty quick.

Document everything!!!!!

That is what I finally had to do and when I started doing that it only took two weeks from there.

You'll be fine, just make sure insurance totals the car. Accept no less! Get yourself a new 370z and love it just as much. You didn't get hurt and nothing else matters.

Ya if you financed the car, you have to have full coverage + gap. That's how it is in Ohio anyways.. Best of luck dude

Thanks guys, im going to pursue them, when we did the insurance we made sure it was a full and i know i have gap. Tomorrow i will find out, regardless im going to get a lawyer if they don't pay. (this inside worry feeling is killing me minute by minute...)

We switched insurance couple months ago and i know we did full + comp because its required on a finance car...without it my financier would have took the car from me...but i have nothing to prove against to them, they said i didn't..

Dang... sorry to hear. :( you'd think insurance would help u out when in time of need. As soon as everything is done with the claim, change your insurance co.

Sorry to hear that man, just as I thought I had it bad for much that we take care of our babies nature and dum drivers we can't avoid =( some idiot hit my rear last week and took off for more that I tried to catch him he took off was so furious you wouldn't believe it. But in the other hand that's why we pay for insurance so just let them handle it and get urself a new one =))

I know the feeling. My 350Z was partially flooded during the Tropical Storm of 2008 that stay in Central Florida for days. I had the car for only two weeks. The insurance paid for it but the car was at the dealer for almost a month and the feeling of the car being flooded never went away.

So for now it might sound bad, but is good you have insurance + gap which will allow you to get a brand new car. Hope everything comes out OK!

The only problem is my insurance said i didn't have collision or other than collision..I was able to dig out a printout i received online when i bought the policy and shows a 2k deductible on both collision and other then collision so i clearly did add that. But will this paper be enough to fight back??

I hope everything works out for you. Did you have flood insurance on your auto policy? The reason I am asking is because this area is not considered a floor region and flood insurance typically is not included with most policies. Allstate is my policy holder and I had to add flood insurance to my car and home policies in order to have this coverage.

That doesn't make sense. You need to have (Full Coverage) insurance for collision and comprehensive on a finance car. For example my bank only allows my deductible to be no greater than $1,000 other banks/FCUs might be different.

What ins. company is that?

That copy might be enough but you might need a lawyer? Don't know about any government office that could help you.
