2009 and early (pre April?) 2010 cars could have the oil consumption issue, but most don't (mine doesn't even heat the oil!).

It is possible the ECU doesn't make the high-pitched whine that a few 2009 made. It is slightly possible the interior noise is slightly reduced in late 2009 models.

I wouldn't worry about it. I got an extended warranty with mine, verified the previous owner had stretched an oil change, and was fine.
