Keep them, if you trade the car in they will need to be re-installed or risk a big fine. Dealership will get fined big time. They will have to install

Keep them, if you trade the car in they will need to be re-installed or risk a big fine. Dealership will get fined big time. They will have to install cats back on the car before they sell it. This will decrease your trade in value and will get you in big trouble if you don't tell the dealership before the deal is done.

Not true as it depends on your state and municipality's laws as they are all different on a case by case basis.

EPA overrides local laws. The EPA will go after the dealership. That is who hands out the fines.

Having worked in a dealership in a town where emissions are nonexistent for 10 years I can tell you that this simply doesn't happen. Whether or not it's federally mandated, I can tell you from seeing it first hand that the dealer's generally do jackshite about it, GRANTED that's from my anecdotal evidence of my experience and have no idea how dealers operate where there's smog testing.

I've seen up to $185 paid out for both cats for scrap metal (not in TX)

If the dealership is too stupid to recognize that cats are gone before buying a car, that's not the customer's problem. A buddy of mine totally forgot to tell his shop to remove his test pipes when they removed his exhaust before trade-in. Dealer missed it somehow and tried to say something about it after they had already signed off on the deal. My buddy told them tough $hit and walked out with payment for his car; later he went back and offered them the stock cats in trade for his TPs and labor to swap them. The dealer balked at first but eventually took his offer.
