Default Bad Car Deal

So my dad recently purchased a vehicle for my brother.

It's a 2008 Dodge Magnum with 82k. They grossly over paid (I told them not to purchase because of many reasons). They owe $11,400 to the finance company. The problem is the vehicle gold with an open recall in the ignition has issues causing the car not start. There is no permanent solution or fix. My father was unable to go to the hospital due to this issue.

the car was purchased less than 30 days ago and the dealer will not simply take it back. the dealer will allow us to find a different vehicle on their lot and then pay full price no negotiation. They will give trade in value of $10,500. I know they are playing a numbers game at this point. I went to other dealers and it's what I've thought the vehicle is only worth $7,000 or so.

What are my other options? The salesperson was not only rude but seriously a ****. They are very shady because they will go to the hospital for my dad to sign papers.

Oh and the kicker is the interest rate for the loan was 7.25%.

Sorry to hear this, oldschool. Not sure what to tell you, other than to review the used car lemon law in your state. Your profile says you are in Buffalo, so I presume it's the one in NY and not somewhere else. Given that, check out this site -

The only Magnum worth buying is a SRT8 if your lucky enough to find one and overpriced for one that has 82k is an understatement. Sad to say, but sometimes it's best to just deal with the major dealerships, at least they have reputations that they are willing to protect.

Thanks Memphis that certainly helps. We called a lawyer in regard to the lemon law and he stated it was not covered under the law because it's too old.

And you're correct, I'm located in Buffalo NY. This is a local Honda dealer and the salesperson admitted they know nothing about other vehicle makes, additionally they didn't know there was an open recall.

Just sucks because my dad has cancer and doesn't need this stress. We know he is losing money just a matter of how much.

I agree 100%. I told them not to buy this because
1) it's way overpriced. I think it's only worth $8,000 private party value. They sold it in bad condition as well.
2) rear wheel drive and not desirable
3) bad reviews of the dealership
4) interest rate too high

They already have a lot of bad reviews, I don't think one more would matter to them. But I will put a bad one on every site they are listed and contact the local news stations. Nothing will come from it but I might feel a little better.

Yeah, I forgot that the Lemon Law has age/mileage restrictions. That noted, if the dealership sold your father the car knowing that there was an open recall issue, that might constitute auto fraud. I would do a search for attorneys in Buffalo that handle auto fraud cases and speak with at least three of them to find one that you connect with and that you feel understands the situation.

Thank you again. I will try to find one in my area. It's just tough I literally just felt like crying yesterday because of all the stress. I feel like nobody should go through this, let alone someone sick in the hospital.

The lemon law has so many loopholes, I'm not sure you'll get anywhere with actually hiring lawyer anyway. I wouldn't waste my money. I say take the trade in offer, get a better car, eat the $900 difference and move on. Sell the car in a year and be done with this dealership. You said you wanted less stress right?
