Ok update... I am sueing jerod this will take about a year at the most.In the meantime back at the ranch.. Next month I am putting a new motor in the Z..

Okay here's an update got my Z Pack October 21st. The cost of a rebuilt motor was 9863 dollars. Installed by Nissan. Now I still have to go after Jerod my total lawsuit against him is 47000. The dumbass has been served but what I think he's going to do is file bankruptcy to avoid the lawsuit.

What else is included in that $47k? That's a huge jump from $9700. How are you going to justify that in court?

Sorry if I missed it, and don't mean to be a downer here...but was there any liability disclosures for the tune? My EcuTek tune had me acknowledge that I'd accept responsibility to what could happen for better or worse. Not sure if it was because it was a remote tune, or goes for any EcuTek service from the vendor.

And yeah, I'm lost on the $47k part as well.

It's unfair trade practice and deceptive practice. He made a bunch of statements that weren't true so by law you are allowed three times the amount you're asking for

Ok, 9900x3= is a little under $30k. Where's the other 17k coming from? Do you think that asking so much over the amount of damages could hurt your case? Is the shop's insurance one of the named parties in the suit? That may be the only way you see a dime.

I completely understand your pain but sometimes you've gotta give an adversary a way out in order to gain from victory. There's no way in hell he's gonna shell out 47k on this even with a judgment. We know that already from the company that shall not be named but begins with a G and ends with an M. Regardless of what's allowable by law it's smart to make concessions in order to achieve the desired result. Ever wonder how a guy who shoots 3 people in a parking lot is only convicted of aggravated battery instead of attempted murder? The most likely reason is that the only way the state can get him to admit what he did is to offer him the lesser charge or take a gamble that one of the twelve idiots in the jury box believes that he really was abducted by aliens the night the shooting happened. Attorney fees plus what it really cost you and a small amount for your inconvenience is much more likely to be achieved than 3x the cost incurred. Not a judgement just an observation. Good luck if you can squeeze it out of him because he does deserve to be squeezed.

I gave him almost 3 months to fix the vehicle. Plenty of opportunities. He himself took the vehicle to 3 different dealerships and they told him the motor was burned out due to his actions. Then he said he would submit it to his insurance company and he didn't do that. I told him just fixed a motor and I didn't want anything else he didn't do that. He put himself in this position. He made himself face these illegal burdens. But anyway take care to me it sounds like your Jerod lawyer. And it was fine with him to stick me with the bill. And just walk away.

Nobody was saying just walk away. We just don't think it likely you will be able to get a judgement for that much.

Yes, because we're suggesting you be more realistic so you can actually get something out of him we're telling you to walk away. Yeah, that's exactly it.

Dude, wash the sand out of your vagina. I'm well aware of triple damages, I was just asking what other things were lumped in there with the cost of the motor. Some of us just thought that a more reasonable ask would be less likely for him to just declare bankruptcy and leave you with nothing.
