Default ~NISMO vs Deer thread/Cubelord continued~ : Help keep my bodyshop sane?

So my insurance company is beginning to get cranky.

Went to pick up the car on saturday after everything was "fixed" and found a few minor issues, two of which were easily resolved.

The 3rd has us (including Nissan) stumped so I'm hoping the expertise here might have a few suggestions for us to try.

Situation:
Deer struck the car in the left front fender and dragged along the side of the car, destroying my mirror and a bunch of other stuff. It did not impact the front of the vehicle. Pics and details here:

I hate deer - no seriously

So anyway, when I go to pick up the car, right where the front spoiler mates to the...(I'm not sure what it's called, it's a dark gray piece of plastic that attaches to the bottom of the spoiler - air foil? fake-diffuser?) there's a small gap right at the wheel well on both sides that definitely was not there before.

Body shop guy tinkered with it for a while and couldn't figure it out. Eventually they gave in and called my insurance and are now replacing that whole "diffuser" piece in the hopes that the problem will be resolved but they don't sound very confident that it will.

Ideas? Is there something simple they're missing? They tell me that the diffuser/foil piece fits snugly around the rest of the front of the car. Sorry I don't have pictures of the gap itself but it was hot as hell when I went to pick it up on Saturday.

The car is a 2012 NISMO.

Here. This is the best picture of it. Man I have no idea what we did before the internet.
Call body shop 40 miles away. "Hey take a picture of that". 10 minutes later it's up for everyone to look at:

See that gap right at the bottom? I HATE THAT GAP.

That gray plastic piece is being ordered and should be delivered tomorrow. My fear is that they're going to put it on and it'll still look like that and I'm going to burst a blood vessel.

not sure how that piece is mounted, but can't they just use silicon glue or something worst case? loosen screws, glue, prop it up. it doesn't look unrepairable.

The entire piece is being replaced and I won't "settle" for glue or something like that. Needs to be the way it was before the wreck. Like I said, just a little concerned that the new part won't fix it and then what...

Call me anal retentive but hey this is why people carry insurance. Car needs to be in the same condition it was in prior to the accident. Really sucks that the car was only 3 months old but if you think about it, how many years go by where you pay for insurance and never use it?

I need it back to the way it was (pristine) and although I'm sorry that it's going to cost them a bunch to fix it, I don't feel too bad about it.

That's why you carry (and PAY) insurance! Trust me-they get their "buck" (LOL!) from YOU....
