I would start working on the excuse to give to the dealer when trying to get it fixed.
How about this one..."Honestly, I don't know what happened. My brakes failed  and I thought I would raise the roof and use it as a parachute. I was only doing 50 mph. All of a sudden, it was gone  . Have you seen this before, Mr. dealer?. What do you mean it's not covered under warranty  "How's that sound...

Smart top
There is a mod that you can do called smart top that will let you set a max speed that you can be moving and still operate the top. Personally, with all of the problems that can pop up with the vert tops I would not do this while under warranty. Very appealing mod.
