The dealer kept my car overnight and I picked it up this morning. They took pictures and videos of the top opening and closing and are sending those to Nissan to see if I will get a new top or not.
The service rep I was dealing with told me that the worn area on the passenger side was not a problem. He claimed it would just show some creasing there over time. What they are contacting Nissan about is the rubbing area above the drivers window. I hope he is mistaken. Based on what I've read here, the worn area is likely to become a hole over time and to me seemed to be the bigger issue. My warranty doesn't end until January so I have some time for it to get worse and still be covered. I will post again when we hear from Nissan.
