Need some help!

I was recently involved in an accident when an elderly lady (in her 60s) driving a CRV came and hit me while I was making a left turn to enter a shopping mall.
Now she's saying that I hit her while she was at a complete stop. (which is a total bs since I saw her about 40 ft away, coming straight at me without slowing down) Note that there was a steep incline and as all of you lowered guys know that our cars cannot go over those inclines at a speed faster than 2mph. I cannot possibly cause this kind of damage while going at that speed. She, however, did not see me and failed to even slow down. Tell me, in your honest opinion, by looking at the pictures, will her story hold up in court? Thanks for all your inputs! :tiphat: |

^yea usually cali cops don't even file a report unless there are injuries so I didn't even bother calling them. and she was very apologetic when the accident happened. She apologized at least 3 times.

Looking at those photos, how the hell would you hit her while she was stopped? You would have to have been drifting through the turn :ugh:

If you don't call the cops, at least call your insurance. My wife was hit by a guy with no insurance. I showed up at the scene a few minutes after it happened. I called my insurance company and had them take his statement over the phone right then and there. Later that night the insurance company called me to tell me that the guy was changing his story saying my wife was at fault. They said not to worry and took care of everything for us :tup:

yah, there's no way a claims adjuster would see that and say you backed into her like that.
i say have your insurance handle this completely with the talks and make sure to note about her apologizing at least 3x. like i said in the past, the general public is stupid. :mad: |

This is the entrance where I was entering while making a left turn.
She was nowhere near the stop sign and I only saw her when almost half of my car was already on the sidewalk. She is saying she was stopped at the stop sign before I made my left turn. F'ing lie Now, lowered guys know that we have to cut when entering those inclines and cannot do so when there's a car stopped at that particular stop sign. Doesn't make sense to do that unless I intentionally try to damage my vehicle... |

i've been an insurance underwriter for over 10 years...these types of claims suck...my advice at this point is that there are cameras everywhere today...check with the local authorities/businesses to see if there's any footage

Check to see if the entrance have security cameras that caught the incident.
If so, you can tell the lady you have this on film and it'll be in her best interest to tell the truth. |

Sorry to be a devil's advocate but since there were no other witnesses (aside from your camera shots) and you were making a left you are technically liable for not giving right-of-way due to not having enough time to 'safely' make your turn... that's the BS that may possibly happen. For example I had a friend who was in an intersection light was red, so he proceeded to make a left, a d-bag decided he could still make the light (it was already red) and t-boned. My friend was 'at fault' when the other driver clearly ran the red-light.
Then again if it was a stop-sign and she failed to stop that's another story. |
After seeing the intersection, her lie is a little more viable. There is no stop sign. The markings on the ground are not enforceable traffic signals, unfortunately. If she was in her lane when the collision occurred, that makes it he-said-she-said. Sucks man. GL with everything.
My argument if it went to court would be that you have to take that entrance so slow, that you are giving yourself significantly more time to cross the intersection. You couldn't have possibly been moving fast enough to do that amount of damage to both cars without ripping off your front bumper on the driveway entrance at the same time. |

Yea I really hope she gets screwed for changing her story. It's brutal to have to deal with all the head ache.

Yea, it's pretty much up to my lawyer now. He was basically saying the same thing that it's not gonna be an easy case. I just feel bad for actually feeling any kind of sympathy for this lady. f'ing stabbed in the back

Another thing I'll recommend when you get into an accident:
Pull out your phone and start video recording immediately. I walk around and pretend like I'm taking photos. When I'm done with that, I will approach the other person and start chatting them up about what happened. Keep the phone recording, and try to get them to admit fault and/or apologize. Then you have audio of their side of the story at the time of the accident in case they change their story like virtually everyone seems to do. Disclaimer: I live in Texas where it is perfectly acceptable for one party of a conversation to record audio without the permission of the other party. In some states this is not legal, so I urge you to learn what legal actions you can and can't take to protect yourself in your location. |

Finally got some good news for a change :tup:
After a month long investigation, the other insurance company accepted that I was not at fault and they will take responsibility for all damages from the accident. (For those who don't know, my Z was hit by another person about a month ago and she lied that I caused the accident) :shakes head: I'm also getting the Z back this week...I haven't checked with the bodyshop with the progress.. hope everything comes back as good as new :eekdance: |
