Good luck with your issue. This is the reason why I have a camcorder recording everything when I'm driving. It already paid off once when this POS Subaru beat a red light while I was on the main road and had the right of way. He was trying to blame me for the accident at first, so I called the cops, took our statements and then I showed him the video with the cop present.

Lesson learned. Some guy back into my wife. Begged her not to call the cops to which she obliged. He said it was his fault but wanted to exchange insurance information. That would have been a red flag to me. He rushed home to call our insurance company and blamed her completely telling a completely different tale of events. Cops get called always now.

I was getting some gas today and who walks by my car but a Sheriff....
I was like oh dang I'm going to get it...and then he gives me a compliment :)

long story short, I asked him what would be the best way to go about such situation,
and he said that I should take as many pics as I can and record the accident on video and record all conversation and the scene of the accident.
He also mentioned that I should inform the other party that I'm recording the incident on video before doing so.

Another thing he told me was that most CA police will not file a police report
unless there's an injury to either party. So there's no need for calling the police.
He did say that Highway patrol will always file a report but the accident has
to occur on the freeway...
