Default A very clever dealer scam

Contract dealer/client : black car 2010 build, in maker’s stock. Deposit paid.
Dealer order to maker : an hour after client departure: Brownish car 2009 build (15 months old)
Order to maker : falsely lists client name: absolutely NOT authorised. (discovered a month ago!)
Maker invoice : 2009 car. (2009 spec, wrong emissions, wrong mirrors etc.)
Client to dealer : on first sight of car: “wrong colour”
Dealer CEO to client :“this is all we could get” or “wait 4 months for black” (A “Bait and Switch!”)
Client to dealer CEO : I’m not having it.
Dealer CEO to client : feigning distress, gives discount on colour
Dealer invoice to client : “2010” car (failing to show the out-of-date specs)
Dealer to licencing folk : “It’s a 2010”. (European cars’ VINs are NOT decodeable)
Licencing Authority : “Manufactured in 2010” is on its licence.

SITUATION:
Client believes (only for 3 months) he has a 2010.
Client knows that dealers, inspectors, customs, parts shops can ID the car and accuse him of fraud.
Licensing authority “knows for sure” it is a 2010 (because that came from a “big shot” dealer!)
It is licensed as a “2010”
The maker eventually admits it was made in May 2009….but heck did not the client order exactly that?
The dealer, for years, pretends not to know the age (but told “2010” to the authorities).
Dealer rejects the warranty: twice: on known problems, starting at 2 months old.
Client writes to manufacturer, a complaint, and suspicious of the age, after 4 months.
Manufacturer does not bother to reply (to a client who ordered a 2009 and thinks he has a 2010? Nuts!)
Client refuses to buy parts which should be under warranty.
Client is now taken as a proven fraud. Just another ignorant moaning customer.
Client is universally disbelieved:
a) The manufacturer “knows” he ordered a 2009
b) The authorities “know” it is a 2010
c) The dealer CEI stonewalls that she “does not know”.
d) The client knows he’s been conned…and is being conned…for 3 years
e) Lawsuit required
The client is/was a trained 4 year full time apprentice engineer and a proven successful engineer/consultant /tester/racer, a commissioned military signals officer, and Police Inspector (with 6 months full time training) and thus with the professional know-how to prove, not guess, an accusation. Job done.

OK, so after 3 years the truth came out. Client got his money back. Would other makers do that?
The Manufacturer took back the car…..to another dealership.
The Licencing Authority still hide behind “secrecy laws” and do not want cast iron evidence (no shame there!)

The dealer CEO still stonewalls, thus supporting the licencing folk.

The local “Vehicle Importers Association” is run by…..you guessed it…the CEO of the dealer!
The dealer name? Garatge Sport (spelling is correct) in Andorra.

A likely scam …for years…but licencing folk do not want to know!

I tried my best to understand what you were talking about but here's my .02.

It's not a Nissan dealer. That's your issue. Also 2009 and 2010 models do differ. Next time do your research before accepting a car from a non-authorized dealer, especially if you're skeptical.
