I say just go in and start flipping desks over.

If they have a coffee maker, throw that.

Throw chairs.

Rip off your shirt like you're about to go full retard Hulk on them.

Screw the service manager, go to the owner.

Very politely let him know that your lawyer has seen these pictures. See what he has to offer. Bear in mind that he will probably ask you want you want.

what do you think you could get based on the info available?

Chuck33079 05-07-2013 08:28 PM

Unless there's actual damages you could claim in court, I wouldn't mention the word lawyer.

nmjaxx9 05-07-2013 08:32 PM

Ohhh hellllll no they better pay up. Another nismo tell em bill it. :roflpuke2:

Tribalpinoy91 05-07-2013 08:33 PM

Damn man, i would be ticked.

KaienZ34 05-07-2013 08:53 PM

That sucks for sure, but why is the car in your avatar a regular z and a nismo in the pic?

Edit: Never mind, I see you've done the nismo conversion. :driving:

I think it would be hard to demonstrate damages beyond the $0.56.5 per mile

Cmike2780 05-07-2013 09:31 PM

If those two don't get fired or at least deciplined for their actions, blow this **** up on the Internet and social media. The last thing they want is bad advertising. I'd still contact Nissan NA and file a complaint.

This is precisely why I turn to the Internet for my advice. Excellent idea!

Sure the car can take being driven hard, but if anyones is going to enjoy driving hard in MY CAR, its me! not someone who is not the owner!
anyways, hope all is well. Let us know if you take further action besides just talking to the manager which seems like you already did.

It was in Battle Creek.

The Service Manager told them specifically to take the car and pick lunch up and come back. He also admitted that they drove it hard at times to replicate the issue I was having, which I did say that it happened under hard acceleration. The Service Manager took full responsibility. There was also a reason why there were two service techs in the car as well.

There appeared to be a valid response for every question. I think by me saying those key words "hard acceleration" makes a grey area where they could be pricks about the whole situation and have an easy out.

Going forward they are going to log any mile that goes on my car and why.... However, that is if and when I take my car back to them. I will most likely do the work from here on out myself.

I'm looking forward to having a lessons learned conversation with the owner after my car has been completed.

AKA - Ask him for the keys to his GTR so I can get some Burger King.

Chuck33079 05-07-2013 11:17 PM

Well, I can see where they are coming from if you were having them look at something that occurs under hard acceleration. The food thing bothers me a little. I don't eat in my car, so neither can you.

37ZERO 05-08-2013 06:16 AM

I had a similar situation when I had my Renault Sport.

The car was quite heavily modified and screamed thrash me. This led me to install a ROADHAWK blackbox camera system, it records audio, forward camera footage, gps speed and position and g forces. Everything is saved to a SD card and can be read on a laptop

I dropped my car in for its 30k service clearing only the fuel economy (I recorderd km but didnt clear them). Picking the car up it had done almost 30km and had an average fuel economy of 42.8 litres per 100km!

I calmly asked the service manager who had driven my car and where my it had been, he wanted to shut down any questioning quickly and told me the dealership uses a preplanned 3km route and he goes on every drive with the technician to ensure the cars are driven properly. I asked him about the excessive fuel economy and km where he then told me I mustn't have cleared the vehicle data properly (funny that I was into my 3rd year of ownership!).

I pulled my laptop out and the SD card from the recorder and asked for him to give me a moment. The footage shown a single mechanic get in my car, thrash it from cold and exceed our maximum speed limit by 20%, he took the car on a journey almost 30km long through a mountain pass.

At this point I went back into the dealership and asked to see the service manager, rolling his eyes at me he led me into his office, immediately I asked for the DP to be present.

Cutting a long story short both the service manager and the technician were fired, the tech for misusing my car, the service manager for lying. I had my service fully refunded and was bartered with to keep quiet and delete the footage

Handle the situation calmly, ask for the dealer principle especially if the SM told his staff to buy food in your car. I now work in the car industry and this kind of disrespect for your vehicle would justify the loss of jobs.

That's awesome. I've wanted to get one of those recorders for insurance purpose. A lot of crappy drivers on my commute and after my last experience at the dealership, I really don't trust leaving the car at the dealership anymore. If I bring it in for service, I'll wait and make sure to let the tech know I'm looking in as he's working on my car. It sucks, but you don't really have a choice if you need warranty work done.

How big is this device? Where do you mount it so it's out of sight? Got any pics of your installation?

It's sad that those with high perf cars have to go protect themselves to such an extreme. Chances are higher end car shop techs don't abuse cars like those at mainstream dealers. After all, how many Z's, camaro's, vettes's, etc do these dealers see on a regular bases.

Vaughanabe13 05-08-2013 11:11 AM

Now I'm going to be paranoid my dealer techs are driving my car around. I was asking them about the high pitched whine I was getting, and of course it couldn't be duplicated in the shop, so the service guy said, "We'd be happy to drive it around for you and listen for the problem!" I was like HELL no. Something about the excited way he said made me think of the valet scene from Ferris Bueller.

Vichtz 05-08-2013 02:29 PM

This forum and DIY is the only dealership I need. **** warranty, techs, and all other manner of ingrates that may excessively pilot my car...

A couple of 19-20 year olds who happen to have loved cars enough to make a career out of it.

Before we call for their heads on a plate, let's consider their point of view. They are wrenching all day on Rogues and Pathfinders and in rolls a 370Z. They do some suspension work and when its done they decide it should be road tested before we hand it back to the customer. So far no crime committed, at least to me.

Ok, While were at it we'll pick up some lunch, oh, and see if the shocks reduce the roll while getting on it a little.

I can see this happening without any malice or intent to deceive anybody, yet some of us would send them home to tell the wife and kids, hey, lost my job today because someone who can afford a nice car didn't like me driving it and getting lunch.

Just sayin...

The next time you leave your baby at a hospital, go ahead and let the young 20 something nurse take it out to lunch. Hell, might as well get some shopping done while shes out. That argument is terrible.

IMO, they should be fired. It's not an ethical practice to joy ride the customer's car. Road test to check that everything has been installed correctly is fine... but going out to get lunch? I'd fire them on the spot as I don't want that type of person working for me.

kenchan 05-08-2013 02:45 PM

yah, imaging telling the manager of the shop you're going to call up the local news station about it. they would have a field day. :icon17:

F*ck that! Not his car. Period! If he cared about his job and his family so much, he shouldn't do something stupid to get himself fired. That guy/girl with the nice car worked just as hard to pay for that car. When I leave my car at a dealership, I bring it there for repairs, not to make your day less mundane.

I'm an architect. If my client let's me into thier house to take some notes and measurements, I'd sure as hell lose my job if they caught me in their hot tub....and all because some rich a-hole who can afford a nice house didn't like me naked in their backyard....just say'n.

Hey Ziggyman, you did this before, huh? :icon17:

I can see your point of no malice or intent to deceive. So I'm in your camp, providing this is the 1st time these two techs did this. They should not be terminated. However a stern written warning should be issued to them saying that if this ever occurs again, termination will be swift.

In my opinion, if a road test has to be done on a car, then it should be done strictly for that purpose. The tech should also record the route, mileage, speed, quick turns, hard braking etc, everything done on that road test and results. Doing it this way will protect the dealership as well as give us (the consumer), assurance that the dealership took a professional approach in repairing our vehicle.

JARblue 05-08-2013 03:41 PM

I'm heading to the dealer right now with my Z, so a couple of techs can drive it around to blow of some steam :ugh2: Keep in mind, this is the same dealer whose techs said that to remove the front fenders on a Nismo, the doors had to come off... plus they didn't remove the side skirts

My Brother is a mechanic for Battle Creek Honda. You just don't get to grab some lunch in other people's car. That's not how it works. Moreover, my car was never finished when they were getting on it. I'm pretty sure they could have tested the vehicle a number of ways.

They could have handled the situation much differently and it leaves a bitter taste. I'm not really pushing the issue with the dealership right now. I want the work completed on my car first and then hope to have a civil conversation with the owner.

To their credit, I have had excellent customer service from that particular dealer in the past... I guess you are only good as your last job.

Wow!

Kidnapping a baby from the hospital = test driving my Nissan that was in for service?

I'm just saying that when I was 19-20 not every decision I made was well thought out and prudent. I guess I'm the only one.

It does not make them evil but they obviously screwed up. Some overly tight shorts I think.

Xplicit97 05-08-2013 04:54 PM

I think some people on here demanding the techs heads on a silver platter are missing part of the narrative. The part where the op says THE SERVCE MANAGER told them to go grab lunch in the car while doing their test.. They were doing as they were directed to by their supervisor.. Yes these are our babies, but at the end of the day these are merely cars.. No harm no foul, had someone not seen the car out, you probably would be none the wiser... Now if there was damage due to negligence by all means crucify them.. just my 2 cents

Clearly the service manager is not worthy of being a manager!!!
Fire him.

I do agree, you don't send techs on errands in a cust's car, regardless what it's in for.
