Buyer asking for refund on Paypal

hey fokes :hello:
I just sold my ssr type f to this guy on the forum. So before I sent the wheels to him, I post on the forum asking for help to remove the center caps on the wheels since I didnt say it is going to come with the wheels. So this buyer commented on my post asking if I am not shipping the center caps with the wheels. But I didnt answer him since the answer is so obvious. So he paypaled me the money after but never ask about the center caps. After he got the wheels, he asked for refund on Paypal since he said I didnt ship the center caps with the wheels. However, this shitty guy didnt even text me or message me beforehand about putting a dispute on paypal, he just did it. I was like WTF now my acc is like -$2xxx. My reason is that I didnt say anything about the center caps on the post, therefore Im not shipping it. Plus, I got like SUNKIST boxes and mats in the picture, he didnt expect me to ship those too right? So IDK what do you guys think and give me some idea so I can win this dude on Paypal. :icon18:

Heres the post I put on for sale,
http://www.the370z.com/parts-sale-pr...0-5-tires.html

And heres the post where I ask for help and the guy asked if Im letting it go or not.

There's probably nothing you can do now but accept your wheels back. I think a lack of quick communication would of prevented all of this.

I think most people think center caps come with aftermarket wheels. But since you took pictures with it on, you can't blame the buyer.

If you can, you should see if the buyer will accept the wheels if you ship him the center caps free.

but he has a complete idea that the center caps were not going to come with the wheels because he asked me on the forum before i even shipped the wheels. anyhow Im going to wait for paypal to make the decision and i think they will stand on my end because the buyer already knows what he will be getting and I didnt mention anything about shipping the center caps so they cant just assume it is coming with the wheels.

Pay pal is not going to side with you on this. You posted photos of the wheels with the center caps on them. You never explicitly told the buyer you weren't including the center caps. You just stated in your first post that you didn't even respond to him when he asked you if you were sending him (which was pretty arrogant in my opinion). I think your best bet is to work something out with him or watch yourself get hosed by paypal, but you do what you feel is best. YMMV.

Paypal will side with him and you will loose your $$$ because you didn't send what was pictured.

This is a tough dilemma. Bottom line is what was in the pictures must be included in sale if stated otherwise. You can't just assume people know that this or that isn't included. For example if your selling a car and have rims on them but don't mention your removing the rims, the buyer is expecting the rims to be on there. You should've made this clear before hand. After the fact, it's going to be tough. How much are the center caps anyways?

Ding ding ding.

While both sides of this transaction could have done a better job, as the seller your failure here is reason enough to side with the buyer.

In the future, just communicate. The 15 seconds it would have took for you to post a reply would have been the professional thing to do. Not doing sois what could lead people to speculate you were trying to hide something.

He can send the center caps, however he already short $2,xxxx from his account. The dispute in PayPal is going to takes months.

I been thru that with PayPal they will take the money and ask question later.

The loss is a balance they show in their account, not a withdrawal... until collections gets involved.

If you resolve the dispute with the buyer, than can cancel out the balances.

who just does that?? no offense but thats just kinda rude to ignore a possible buyers questions about your item, then get mad when there was a miscommunication...

:iagree:

this all could have been avoided by answering the buyers question. you can't assume the buyer knows when he outright asked and you did not respond. the pictures clearly show the center caps, and no where in your for sale thread did you mention them not being on the wheels. that you didnt mention they would come with the sale is irrelevant, they are pictured.

bottom line, you owe the buyer a refund or a set of center caps.

SiXK 05-22-2012 08:53 AM

you posted pictures with the center caps, then removed them without a word to the buyer, then ignored him when he asked about the center caps?

I can't imagine why he'd be unhappy...

Regardless of who is right or wrong here, Paypal has a simple matrix for figuring out these things. 1) Buyer or Seller complains 2) PayPal determines who is Buyer and who is Seller 3) PayPal sides with Buyer. 4) End.
