The Mass courts denied it and since then it's been put on the books in Mass that no insurance co has to pay out for DM. Do a Goggle search and you can read the entire court case and decision. Many other states, DC,NC and others down south have started paying DM claims but it won't be easy here in Mass. You will 100% need a lawyer. I hope you have some luck but I think you're going to really have a battle on your hands. My family member is still waiting for their car to finish being repaired. He wants to trade it in asap after it's done and the dealer said it would be a 5500.00 loss to replace the car. It was not a sports car, but his first ever new car and he is devastated. I probably shouldn't give too many details about the case since he is still in the process of doing the claim.

Please keep us up to date on how it goes so and i'll let you know if he has any luck. Perhaps we can help each other out. I think it's time Mass gets with the program and acknowledges these claims. If it was me, i'd be fighting this to the end with a lawyer. Even if I only got a little money, I'd be more hoping to change the law so they have to pay DM for everyone in the future.

And sorry about your 40th, I really love the color combo inside and out. I'm sure a good body shop will make it look great again, just be picky, if something isn't perfect, don't accept the car until it is! And you just can't win anymore when it comes to where we park. I've always park a mile away from the masses, in a corner spot, etc. It's great until a group of teenagers sees it there, all alone, no people watching them, and they key the entire side.. Not on my Z, but my Maroon Titan. We're screwed no matter what.
Most of the security cameras are going to be focused on the closer parking spots, in which case, a detective can pretty easily tell who did it, if they went in the store and bought anything.

Little update for you all.........I brought in the Z to the dealership yesterday to start repairs. They will be replacing the entire rear bumper as it was basically ruined when the lady repeatedly tried to back out of her parking spot, there is a large hole where the bumper meets the quarter panel. I wont list all the parts, but the entire left hand side has to be repaired, except for the front panel over the front tire, which surprisingly has no damage. The back driver side wheel has to be replaced as well as the side mirror too. I looked at the appraisers costs for the gunmetal rims and it looks like each rim costs roughly $775 to replace. After all these parts are replaced they have to apply the paint and clear coat. I JUST FOUND OUT
that they found an additional 1200 dollars worth of damage on top of the original $3000 grand they found a few days ago. I spoke with the services manager and he didn't have the details about the additional damages they found, so i need to call tomorrow about that. I will keep you guys updated and post pics when everything is finished. The dealership also wants to do a story on the repair job and post before and after pics on their website, so ill let you know when thats done.

Damage doesn't sound to bad.
Also avoid thing that they want to do an article on it.
That secures you that they will do the best job possible.

Dude sorry to see the damage to your car. What the shop has found is called supplemental damages which occurs most collision repairs other than very minor damage. As for selecting a body shop do your homework on selecting a shop. I have been managing body shops for over 15 years and have over 25 years in the bussiness. Unfortunately the last place you should go is where the insurance company sends you. These shops often give discounts and concessions to the insurance company to recieve their work. This is only good for the insurance company and not the body shop. The body shop must then cut corners, buy cheaper materials, hire cheaper techs, ect in order to counter the dicounts they offer the insurance company. This does not lead to quality repairs.
As for going to where the dealership reccomends this is usually a better choice because the dealership has there reputation at stake and if they refer a lousy shop the customer will remember when it comes time to buy a new car. Reguardless ask around and ask to see work they have done and inspect the facility. I have found that body shops that are clean and we kept generally do better work. It is a matter of taking pride in your work and what you do. The best shops I've seen have been small Mom & Pop shops because they put their name on every job. In your case insist on brand new OEM parts as your car is so new. Generally most insurance companies will do this for cars less than 1 year old and with less than 12,000 miles. You can still insist if you are a claimant (not your insurance company) as your car had original parts on it before the accident which was caused from their client.
Also make sure the shop offers a Lifetime guarantee on their repairs as sometimes it can take months or years for problems to occur. Such as rust from improper welding or damage from a water leak to develop. When the repairs are complete inspect the car very carefully as it is easier to correct any problems before the car leaves the shop. If problems are found get with the owner or manager and arrange for this to be fixed before you pick up the car or return your rental (Always inspect the repair before turning in the rental car or they may not put you back in one).
As for inspecting the repairs you the first thing to look for is color match and the texture of the paint. It must be consistant with the panels that were not repaired. This is often refered to as orange peel and most cars have some degree of it in the paint. Next check for panel alignment making sure gaps are even and straight. Now look down the sides using reflections to see and minor defects fron repaired areas not fixed properly. At the same time look for die back/ Sanding scratches under the paint (these appear as Blotchy or hazy areas where the top coat of paint was applied before the primer had fully cured). Nor open the hood doors and liftgate and check for paint edges in the jambs. Also check for loose missing or incorrect fastners. Look for part decals that were not removed from new parts. Under the hood look for emissions and other decals that need to be replaced. If major panels have been replaced the shop should have replaced the vin decals (only a few manufacture allow this) or provide you with the old ones cut from the original damaged parts. Now make sure the doors other panels open and close properly with minimal effort and no unusual noises.
Last test drive the car and listen for noises. If you had suspension work done check for any alignment issues (pulling, wandering, or excessive drifting), Vibrations (caused from damaged wheels, Debris inside wheel, or improper balancing). Check the air conditioning, radio, lights and any other electrical sysems affected from the collision.
Now back a the shop before you sign over the insurance check look over copies of the invoices to make sure they agree with what the insurace estimate says. Make sure you get copies of any frame print out and parts invoices and a copy of the shops Guarantee. Hopefully this will help you thru a difficult time. Unfortunately no matter how well the shop does the repairs you will still know that the car has been hit but at least you can make shur it was repaired correctly.
Feel free to contact me if you have any further questions.

Hope this helps
Rick

Man, I'm so sorry about all of this. I swear, if this had happened to me, I would have killed them.

I mean, how could she f**k up THAT BAD on a parking job? It almost looks deliberate!

I mean, I really can't believe this. Is not possible. I don't know how did you managed that situation.
Take it to the best recommended shop from your insurance company.

There is stupid, there is braindead and then there is this. I mean how in the world did this woman get her car into that position? If it wasn't so sad it would be funny as hell. It looks like one of those epic fail blog pics. It's unbelievable she must have been on crack or something. No way a sober person could ever do this, it's insane.

Rick, I cant tell you how much I appreciate your response. This is my first accident and I will be printing out your instructions and making sure I follow them when i get the Z back. I sent the Z to the dealers body shop where I bought the car, so I am sure they will take care of everything and hopefully i wont have any problems. Thanks again
