When my car was hit I called ins company got 3 estimates, ins said go for it and I took it in and got it fixed and let the ins pay. no hassles.

Now the real important thing to do is to make sure you get a claim for diminshed value as your car will probably show up on car fax and you will lose resale value. I was told to start at 10% of the cars original value new and go from there.

My Story
 
The 3rd time driving my car I decided to take my son to school in it. While in line to drop him at the front entrance many of his friends came over to look at the new ride. The lady in front of me decided to back up and try to get out of line before the car in front of her. She backed right into me as I was talking to the guys about the car. Small dent i the nose and a scrape. I was fit to be tied.

Knowing a body shop guy we insisted on replacing the nose and not sanding and repainting and it looks as good as new.

Good luck getting it fixed and done right.

Not quite as painful in MA. He files the claim through his own insurance company, and his insurance adjuster will come and take a look at it to estimate the amount of damage or declare it a total loss (obviously not in this case). Repairs can be started immediately at the repair shop of his own choosing, any further damages discovered during the repair process are covered by an adjustment claim from the repair shop.

You don't have to pay any out of pocket, his own insurance company will be going after the other party's insurance for the full amount.

even if you let her ins pay for it, you are suppose to let your ins know about it. Not sure if thats law or just so they know.

This was the same thing I was saying and just wanted to make sure you didn't miss it. As they won't offer it up, but with a 2 week old car you have a really strong case and I would make sure you max this out... even 10% sounds low to me...

I must have missed something cause I don't get how she could have "parked" her car in such a manner without noticing she was touching your car? This looks like it was done on purpose rather than just plain bad parking.

I also think I would have lost my nerve... well not physically (no need for that really) but verbally for sure.

Why is it always nice cars that get damaged by fools? You don't see crappy cars getting damaged by bloody nincompoops :(

Yeah...You are owed this and most insurance companies understand why but may not be real easy to deal with. Call the Ins co. and tell them you want to file for diminished value. They will send an appraiser out to look at the car after the repairs and determine 1) repair related shortcomings, and 2) Inherent diminished value from the car now having a record of damage.

I got a couple of grand back after my hit....

This might be totally over the top, but definitely something I would try and do...
But couldn't you take the damaged car, the money you get for the repairs and the money you get for the diminished value all to the dealer and say; "you can have this car as it is, all the money and I want a new 40th..."

They might be able to get a cheaper rate on the repair. And have no emotional problem with it being a perfectly repaired car, which might just make it a good deal for them...

It'll probably take you a few weeks before you forget about it completely and you start enjoying your car as if nothing happened. I was the same when some idiot drove into my car, 2 weeks after I had bought it...
