Breaking News - CSC Class Action Lawsuit
 
SF appeals court reverses lower court’s denial of class-action status in Nissan lawsuit

Finally some long overdue good news!

"A federal appeals court on Friday reinstated a proposed statewide class-action lawsuit accusing Nissan Motors of installing defective hydraulic clutch systems, which can cause a clutch pedal to stick to the floor, on some Nissan and Infiniti models dating to 2007."

"The company issued a service bulletin in 2013 instructing dealers to replace the clutch systems, but has never notified consumers, the suit said. Wu said he has heard many reports of other stalls and breakdowns, but none that caused major injuries."

Don't know if he's on the forum here, but big shout-out and appreciation to Huu Nguyen of San Jose for filing this suit!

And if there are any lawyers here that can comment about the possibility of the class being extended from California to rest of the US, please offer your comments!

it includes 350Z as well.

I am curious why it ends at 2015 as I'm not aware of any changes from 2016 on.

Tbh I think all this really does at most is scare Nissan out of making another manual sports car.

They just announced they were cutting 12,500 employees and levels of production due to significantly declining sales.

This is like more salt on the wound against doing anything ambitious.

This is mostly true. Depends on what they’re asking for in “damages”.

Personally, All I want is my car fixed on their dime. If Nissan were smart (they’re not) they will offer an extended warranty for CSC issues in lei of a lawsuit.

You have the right to “opt out” of a CAS and I would gladly do that if they put in writing they’ll cover the cost if need be.

Ball is in their court, let’s see how they want to play it.

This is a widely known ticking time bomb. From what I’ve read here, it’s not IF the CSC is going to fail, it’s When.

Nissan has been playing with house money long enough. Time to man up!

If the service bulletin to repair was issued in 2013 is it safe to assume that all models after that have whatever fix they're issuing?

If the lawsuit was filed in federal court it applies to everyone.

Nope, they only admitted to a problem in 2013. The defefective part is still in use. To add insult to injury, the “fix” is to replace the defective part with a new (same) defective part.
