Z just got backed up into...

So as I was driving my step-dad to the airport, waiting at a left turn lane for the light, a Dodge Ram 2500 white pick-up van just backs STRAIGHT into us. As far as I am concern, not to be racist of any sort, but it was two Mexicans driving without License or Insurance, I did call the police and they got them and my info. But I will post pics as I always take pics lol. Very angry but happy because I'm going to sue their company for letting them drive without license.

PICS ARE UP! scroll down for them!

koeppelnissan 11-22-2009 11:03 AM

WOW! Sorry to hear that, seems too common lately.

frost 11-22-2009 11:04 AM

In for the pic. Also, if you wouldn't mind editing this post later to include the cost of fix, that would be helpful to many of the people who may get into the same spot.

Matt 11-22-2009 11:10 AM

Not sure if them being Mexican (sure they weren't Peruvian or Cuban?) has any relevance to them not having insurance/licenses, but anyways...

That really sucks. Sorry to hear about that.

I was almost backed into the other day. Luckily the Z had enough takeoff to get me out of harm's way rather quickly.

theDreamer 11-22-2009 11:12 AM

That sucks, really sad to hear about all these people getting backed into. :(

Here at California, most of them drives without License and Insurance.

frost 11-22-2009 11:24 AM

That was a little worse than what I had pictured in my head.

theDreamer 11-22-2009 11:25 AM

Did they have a tow hitch? Seems like a very specific spot got hit around the Nissan emblem.

no tow hitch, it's a 99 Dodge Ram 2500 pick up so the weight of the car is big and also there is a exhaust pipe where he hit me from so that could be why.

yes I was crying on the inside but I kept my cool when the officer arrived because I know they're going down for no license and insurance, let alone I don't think they have citizenship in the US. I will be suing their boss as well for letting them drive out to a job without license since the car is under the boss's name.

Togo 11-22-2009 11:47 AM

Good luck with everything, thats a really **** situation to have to go through.

JakeZ34 11-22-2009 11:51 AM

yeah do you guys have any suggestions as to what I can do? Because they don't have insurance and license, do I just get them to pay me off the record to get it fixed or how do I go about it?

koeppelnissan 11-22-2009 11:52 AM

Doesn't look like they damaged the hood, which means it should only be $3-400 to fix. I had a truck back into my MX-5 lease and get the hood, bumper and lights. I just covered it with the Front Mask and turned it in like that a year later!

Get a lawyer, if they don't have insurance then you can get pretty screwed. Definitely consult a lawyer.

JakeZ34 11-22-2009 12:10 PM

now my insurance policy covers "uninsured" motorist on the road which is what is going on right now, if I use that would my premium cost go up or is that at their own expense saying the insurance company will go after the business?

Take 400 or 500 cash. it's only the bumper, right?

Well the insurance company is likely going to go after them to recoup any money they spend to repair your car and might also go after them for your deductible.

Since it's a company that is liable for this, I would think that a lawyer would have no problem recovering 100% of the costs to repair the car to new condition.

It's really just up to you as too how you want to handle it. Consult your insurance company and see what they tell you. They will likely make recommendations to you or at least spell out your options. As I see it, you have the coverage so you can let your insurance company sue them or you can sue them and not file a claim with your insurance. The only benefit I can see of you suing them is to avoid increased premiums. If your insurance isn't going to jack your rates on this, I'd let them do the suing.

A similar situation happened to me recently but the other driver was insured. My insurance company sued them since they were cited as being 100% liable for the accident. They recovered 100% of the cost to repair, including deductible, and rates remained the same.

It depends on your insurance you need to ask them. As long as you have police report stating you are not at fault then your premium will not go up. If they don't want to pay cash to fix your car, then file a claim thats what insurance for.

I'd get the damage appraised first. No telling if something under there is bent.

kdo2milger 11-22-2009 12:52 PM

first off sorry this happened...

the hood looks undamaged...am i correct?

and the fifth picture from the top, where the rubber seal sepperated...is the engine bay right frame bent or did the seal just pop off?

definately needs a new front bumper...

JakeZ34 11-22-2009 01:32 PM

Personally I've parked this car in the garage and not moving it at all. But as of to the frame being damage, I want to get it appraised because my car is not squeaking when I turn so it might be alignment / suspension or the frame bring bent. NO idea as of now til maybe monday.

molamann 11-22-2009 02:38 PM

Wow, I can't recall how many of my friends got screwed by uninsured drivers in SoCal. Believe it or not, a similar event happened to one of my friend's girlfriend. A car backed into her Mini at a uphill stoplight and floored away, unfortunately she was in such a shock at the moment that she just couldn't recall the plates numbers or even the model of the truck. Luckily, a witness was able to provide statements and the driver ended up being an undocumented citizen.

CrownR426 11-22-2009 02:40 PM

Sorry to hear about the bad news bro...
Did your father and you get some medical treatment?!
If not, you both should go!
It's better to be safe then sorry and it's 100% fault of the dodge ram drivers.
Keep us posted!

semtex 11-22-2009 03:17 PM

Ugh. Not another casualty! What's that big splotch on the ground right in front of your car? Did you car lose fluids?

Eric 11-22-2009 03:35 PM

Sorry to hear this, too many Z's getting banged up. Fortunately, the damage look minor and should be an easy fix. It just sucks being in any accident but it feels a bit worse when the car is brand new.

JakeZ34 11-22-2009 03:41 PM

Yeah it sucks and the blotch in front of my car isn't my car fluid, the ground just so happens to be wet at the moment lol. I was reviewing the picture and I said to myself too "oh **** my car lost fluids." and than checked but none lol.

8 out of 10 immigrants do not have insurance , nor a valid drivers license, in California!

I like you Dad, but that's a bogus stat. 80% of immigrants? Do you have any idea how many "immigrants" live in California? Perhaps you meant illegal immigrants...

Regardless, even illegal immigrants come from many countries other than Mexico, so to call the drivers in this instance "Mexicans" as a stereotypical reaction isn't right, unless of course they were Mexican.

Off my soapbox!

Off my soapbox!

I never singled out any race. But.. according to my wife who works at the local police department, gives the driving status's of the subjects stopped to the officers and processes the citations the officers write, my statement includes all races, illegal and not. Not only do they not have licenses but they also do not have car insurance and the majority of the time the car is behind in registration. :tiphat:

molamann 11-22-2009 07:22 PM

Can an illegal immigrant without a valid DL/insurance sue me if an accident was completely my fault?

Sure can!

cpehaot 11-22-2009 07:26 PM

I think your insurance gonna have to pay. I assume you have full coverage. and this is clearly not your fault so your rate should not go up either. When I had my truck, some guy carrying junk fell off and hit my truck causing $8k damage and never stopped. I filed police report and my insurance paid for it all without increasing my rate.

As I was saying. Not to be racist but literally they are illegal immigrants without a valid license. I hate how they are driving around because they're so stupid and irresponsible. I didn't spend 34K on my car to be backed into by two illegal immigrants. Who can't cover my repair bill. It has nothing to be racist or not.
