Get a lawyer, if they don't have insurance then you can get pretty screwed. Definitely consult a lawyer.

now my insurance policy covers "uninsured" motorist on the road which is what is going on right now, if I use that would my premium cost go up or is that at their own expense saying the insurance company will go after the business?

Take 400 or 500 cash. it's only the bumper, right?

Well the insurance company is likely going to go after them to recoup any money they spend to repair your car and might also go after them for your deductible.

Since it's a company that is liable for this, I would think that a lawyer would have no problem recovering 100% of the costs to repair the car to new condition.

It's really just up to you as too how you want to handle it. Consult your insurance company and see what they tell you. They will likely make recommendations to you or at least spell out your options. As I see it, you have the coverage so you can let your insurance company sue them or you can sue them and not file a claim with your insurance. The only benefit I can see of you suing them is to avoid increased premiums. If your insurance isn't going to jack your rates on this, I'd let them do the suing.

A similar situation happened to me recently but the other driver was insured. My insurance company sued them since they were cited as being 100% liable for the accident. They recovered 100% of the cost to repair, including deductible, and rates remained the same.

It depends on your insurance you need to ask them. As long as you have police report stating you are not at fault then your premium will not go up. If they don't want to pay cash to fix your car, then file a claim thats what insurance for.

I'd get the damage appraised first. No telling if something under there is bent.

kdo2milger 11-22-2009 12:52 PM

first off sorry this happened...

the hood looks undamaged...am i correct?

and the fifth picture from the top, where the rubber seal sepperated...is the engine bay right frame bent or did the seal just pop off?

definately needs a new front bumper...

JakeZ34 11-22-2009 01:32 PM

Personally I've parked this car in the garage and not moving it at all. But as of to the frame being damage, I want to get it appraised because my car is not squeaking when I turn so it might be alignment / suspension or the frame bring bent. NO idea as of now til maybe monday.

Wow, I can't recall how many of my friends got screwed by uninsured drivers in SoCal. Believe it or not, a similar event happened to one of my friend's girlfriend. A car backed into her Mini at a uphill stoplight and floored away, unfortunately she was in such a shock at the moment that she just couldn't recall the plates numbers or even the model of the truck. Luckily, a witness was able to provide statements and the driver ended up being an undocumented citizen.

Sorry to hear about the bad news bro...
Did your father and you get some medical treatment?!
If not, you both should go!
It's better to be safe then sorry and it's 100% fault of the dodge ram drivers.
Keep us posted!

Ugh. Not another casualty! What's that big splotch on the ground right in front of your car? Did you car lose fluids?

Eric 11-22-2009 03:35 PM

Sorry to hear this, too many Z's getting banged up. Fortunately, the damage look minor and should be an easy fix. It just sucks being in any accident but it feels a bit worse when the car is brand new.

JakeZ34 11-22-2009 03:41 PM

Yeah it sucks and the blotch in front of my car isn't my car fluid, the ground just so happens to be wet at the moment lol. I was reviewing the picture and I said to myself too "oh **** my car lost fluids." and than checked but none lol.

As far as I am concern, not to be racist of any sort, but it was two Mexicans driving without License or Insurance, I did call the police and they got them and my info. But I will post pics as I always take pics lol. Very angry but happy because I'm going to sue their company for letting them drive without license.

PICS ARE UP! scroll down for them!

Did he get a ticket(s), for no license and insurance?

That really sucks. Sorry to hear about that.

I was almost backed into the other day. Luckily the Z had enough takeoff to get me out of harm's way rather quickly.

8 out of 10 immigrants do not have insurance , nor a valid drivers license, in California!
