UPS: Damage claims

1 Attachment(s)
Any of you have any success with a damage claim with UPS? Bought Nismo wheels from FB Nissan, got them Friday and one wheel is dented really bad, like it was taken out of the box and dropped bad or something. I've email Jomer at FB Nissan, so I'm waiting to see what he has to say tomorrow however is there anything I should do? Or Just let FB Nissan and UPS do there thing?

Freight Claims

Always claim more than it cost. They usually pay about half. (Not specifically UPS)
Hopefully the seller will file in your behalf. They do a lot of business with them.
Good luck

Cletus370Z 12-06-2015 03:10 PM

You need to contact the shipper, and both of you make a claim. The biggest factor in what compensation you will receive is what the package was valued at (which impacts the shipping price A LOT). UPS might want to see the box and how the wheels were packed before making a determination. If the package was undervalued (as most are), that amount is what you will receive.....Good Luck

~37oZ~ 12-06-2015 04:31 PM

Thanks guys, it seems FB Nissan has valued them correctly based one the brokerage form. Is it going to be a problem I didn't open the packages in front of the UPS driver? He was less than pleasant to say they the least and left hasty lol The idiot was basically tossing them onto my front porch too :shakes head:

enguyen88 12-07-2015 09:19 AM

Just curious, how much did you pay for the set?

JARblue 12-07-2015 10:10 AM

That's ridiculous. But Jomer should be able to take care of you. I'd check with him before doing anything. Chances are he can take care of it for you

Yeah, that's what I'm hoping. I'm just waiting for his reply.

Black Friday deal, a hair under $1800

~37oZ~ 12-07-2015 10:53 AM

Well, I'm ******. Jomer was fired/quit and FB Nissan said "they will look into it".....FML

TerribleONE 12-07-2015 10:54 AM

I have bought a few things from them and they always came through. Keep calling and give it some time. They obviously have a record of your purchase. If they don't take care of it send the wheels back and dispute the charge.

Austonian 12-07-2015 10:56 AM

so much crap being sold now on Black Friday, I'm sure some retailers are using it as opportunities to unload returned or imperfect items.

gl with situation.

I hope it doesn't come to that, shipping them back would be costly :( I suppose I can send it collect possibly?

ask for the store to send you a call tag. then you just either wait for the UPS to pickup, or u drop it off at the UPS center using the calltag.

For you seeing a package getting tossed around doesn't surprise me. Just remember how many other times a package gets handled from time a package is in a courier's possession to the time it gets delivered. The seller should be responsible enough to ensure the package is secured and well packaged before shipping item. Especially true for large, heavy bulky items.

Having worked for a season during college at Xmas time at an airport sorting facility(not ups) I can tell you I am amazed that anything shows up unscathed. i can say I used to see things on larger parcel side get thrown into slides making all kinds of noise . I remember wondering how anything shows up "unbroken" that was the real Xmas miracle. Even on smaller parcel side you would still have like a tiny 1# box that would run down the slide followed by a 50# box that would crush the previous one as it made it to sort area. In order to pull the shipment it essentially had to destroy the item completely otherwise it just kept scanning and moving forward onto the next plane.

Had to go through this when I purchased my Rotora BBK. They arrived chipped and scratched, the seller had insured them for the full amount but after weeks of exchanging emails and making phone calls with UPS they basically blamed it on the seller's packing materials and said they ain't covering anything. I always ship with FedEx now.

FedEx won't pay either.

I tell people time and time again. Insurance will NOT pay a claim of the item is damaged (Maybe 1 out of 1000) Why won't they? Because why didn't you pack it better? They will pay if they lose your item. That's it.

If that's the case, FB Nissan owes me a wheel or my money back. I am not getting stuck with a ruined wheel.

I agree, shipper, or their job to get their money back from FedEx/UPS

2011 Nismo#91 12-09-2015 08:40 AM

I've only had one experience with stuff damaged during shipping. Shipped some bottles of wine from a vacation back home via Fedex 2 yrs ago. It was shipped in a wine box with some additional padding bought from them and I got home to see half of the bottles smashed and the box in very poor condition. They wanted to blame the box for not being strong enough but since it was them who helped me pack it properly before it shipped then it's their fault for the poor packing too. In the end they gave me a check for half the declared value which was good since I rounded up. I was a little annoyed they didn't refund the shipping cost because "the package did get there".

Yeup, pretty much if they lose it within their facility or if it is stolen out of a mail truck pretty much.
I recently went through an ordeal with USPS where an item got to the buyer and between delivery and when he got home it wasn't there and I guess someone stole the package. Kinda dumb but it is what it is

MagmaRed370z 12-09-2015 02:01 PM

This is ridiculous. Call FB Nissan and demand a new wheel. Let them fight with ShittyUPS

I've called them pretty much everyday since this happened. They said they want to wait to hear what UPS has to say before they send me another wheel, not sure what it matters. They can give me a new wheel or my money back, period. There are no other options. Either they are on the hook, or they get their money back from UPS.

kenchan 12-10-2015 10:10 AM

issues like this makes us re-think doing business with such vendors.

at the end it's just paperwork for the store, if it was me, id prioritize making the customer happy for his FULL set of wheels (ship new wheel with call tag for the damaged one). wtf are u supposed to do with 3 wheels? :icon08:

They said, going forward they are not interested in continuing their online store and will be closing it down, He at first tried to give me a "You're SOL and I won't do anything" type of answer till I mentioned to him, I would contact VISA and ask them what my options in that case are....:icon14:

I would suggest contacting VISA and getting a claim going. If the seller makes good and sends you a brand new wheel, you can then call VISA and close the claim.

Let the big companies fight it out amongst themselves

God-Speed 12-10-2015 02:00 PM

Try to get the name of the GM at the dealership. Call and talk to him. Most times things like this never make it across the GM's desk. The last thing a GM wants is bad customer service from his dealership and bad PR that comes with it. We are talking about one wheel, not a buy back on a car. Hopefully things will get worked out for you!

barncobob 12-10-2015 04:05 PM

Id let Visa deal with it, they have ALOT of pull since they control the $$$

Jimbo370 12-10-2015 05:34 PM

My neighbor works for UPS and he said a damaged wheel would be on the seller. He also said complainers can go to FedEx which is bad business. sorry to hear. I would do the visa thing for an option. wish you well

~37oZ~ 12-10-2015 07:37 PM

So it looks like UPS has agreed to pay for the wheel....I think, however they want to get a hold of the shipper but they said they were not able to do so and now the shipper must contact them. I also tried calling FB today and their lines just rang and rang and rang in a closed loop...this is getting very frustrating very quickly. I think I will contact PayPal/Visa.

If wanting to go this route then link will connect you to a page with said gm. You can also find him on LinkedIn as well as the owner.

Meet the Staff at Fred Beans Nissan

I'd be inclined to also dispute through visa as mentioned just to cover you if they don't, or to help nudge them in the direction of making it right quickly.

Then call the actual dealership as if you were going to buy a car, if they decided to exit on line business then chances are they would not continue to pay for a toll free number to support that arm of the business, nor would they pay someone to man the phones to say they are out of that business.

Aw man, that's depressing. They had some of the best prices!

Hopefully everything gets sorted out!

~37oZ~ 12-10-2015 11:44 PM

Thanks for all the advice and support everyone. I'll keep you guys posted.

~37oZ~ 12-11-2015 02:27 PM

Well, after calling the Nissan dealer's parts department (separate from FB Nissan Parts apparently) they basically told me "Uhh, yeah I'm not sure what we can do, that division is closed down and no one works in that department anymore, They don't order their parts from us they get them direct from Nissan and is treated as a different company, but we'll have someone look into it and call you"....F it, I made a claim with PayPal for the one wheel, we'll see if I get my money back...hopefully they haven't emptied their PayPal account out by now.

zguynate 12-11-2015 02:35 PM

Man. This is some bs. I hate to see you get hosed for this.

If that doesn't work then as I stated in earlier post go to LinkedIn mr Fred himself is on there and active. I've had decent amount of success going to straight to the top of mountain with voice of customer complaints at other companies when getting runaround

Yup, that's plan B. I'm hoping they don't respond to PayPal, then I'll be refunded automatically.
