Frankly I think that the cause of the impaired driving is irrelevant.
There should be a basic motor skills test that can be administered at any time. If someone cannot pass the test, then they are ticketed for impaired driving no matter what the cause -- tired, drunk, stressed ... who cares. They are impaired so they should not be on the road. On the flip side, if you pass the test it doesn't matter if you're sober or have had half a dozen drinks, you have the required minimum skills to be allowed on the road.
