i was checking out the ipod touch 6th yesterday and amazon listed it as having os7. can't be, right? even my old 5th gen is running 8.

It is most likely an older model that hasn't been updated. But once they are connected to the interweb it can be updated. If they sit on the shelve for awhile that can happen even in a store.
