Sounds like a plan. Since the upper pan is already tapped, leaving it alone just makes the install easier. How does it affect access to the oil filter with your oil cooler's sandwich plate? It's a tight fit in there already.

Sure, it makes things a little tighter space wise, but it is a small compromise compared to the benefit of adding an additional 3 quarts of oil to the oil system capacity.
