NYS will actually take an O2 reading, for example - same w/ Cali and Texas I believe. So if its a CEL that you can tune out and make disappear, no big deal.

Thats somewhat new to NV. Even before the OBD2 check I have had cars with test pipes pass a traditional sniffer test here.
