Ticketed for 'modified exhaust'
 
I was pulled over by an overzealous cop and ticketed for 'modified exhaust' after the guy asked me for some obscure paperwork proving my intake was legal.

My intake is the Stillen gen III which is definitely CARB legal but I don't know what paperwork he was talking about. I'm going to court soon and am not sure what I should tell them.

Does anyone know what paperwork/form he was referring to? Does it even exist?

Where did this bappened? And were you doing anything illegal to get his attention? You're the first person I've heard of in 15 years to get ticketed for modified exhaust. Last guy was my highschool buddy and they even cited him for his car being lowered, they even pulled out a tape and measured lol he was driving like an asshat around the school though.

Yep, ask for evidence that the officer measured your exhaust at over 95 db. He wont have it. Case dismissed.

As for the intake bring the CARB cert.

First of all I was driving completely normal as I had a drunk passenger. He only gave me a 'verbal warning for speed' (real nice of him). Second - I was nice as I'm always nice to cops.

Third, I was driving on the freeway in Van Nuys, CA. Yes I got a 'loud exhaust' ticket while driving on the FREEWAY with stock cats and a Stillen intake.

This cop is basically a pirate.

A loud exhaust ticket is a whole other ball game. The law is very grey.

First I'd check with the CA Air Resource Board contact (Mr. Seong Kim, (626) 450-6164) to if the Invidia Gemini exhaust is CARB certified; I doubt it.

Next, you will have to appear in court to contest the cop's findings. Chances are the cop will not appear. Regardless, I would appear with photos showing that you have not modified your exhaust (i.e., it still has mufflers etc.) as the burden will be on the cop to establish that it is too loud.

The exhaust is post-emissions systems, and does not need a CARB sticker.

CARB certification may not be required, but it protects CBE owners from this very type of legal hassle.

California law is pretty cut and dry - the exhaust of a car cannot exceed 95 dbl. If the officer had a certified and calibrated decimeter, then he would have a record of the offending dbl level. Its the same thing as a cop pulling you over from a LOS speed judgement, he says "you were going too fast" and then you go to court, the judge sees that he didnt actually measure your speed, and youre off the hook. The police officer can write a ticket for anything they want, but it will not stand up in court.

The only thing this guy needs is the CARB letter for the intake, and the balls to ask how the officer measured the dbl level of his exhaust. The judge will throw it out.

Do you have an aftermarket exhaust or did he pop you just for the intake?

Does the ticket require you take it to a state Referee?

Those guys would ticket their own mother. Terrible.

Thats crazy that its that easy to get a CARB certification from Stillen. The last time i had any dealings with something like this was with K&N. Im not sure if it has changed since then, but i had a customer need too get a replacemant CARB sticker for his intake, and they made him jump through a million hoops before they would give him another one. They needed a picture of the intake installed on the vehicle, a copy of the registration, the original receipt.. Just seemed like a lot, but im sure they have their reasons.

My ticket ended up only for No Front License Plate, so I bought one, anyone else in So Call need to borrow it to get a sign off for your ticket, let me know, this holder mounts on the Two Bolt
