Lol, well for one thing if someone is tailgating me I'm not going to slam on my brakes anyways... I don't want them smashing into my car!! Even though it would be their fault and their insurance has to cover it, you still have a smashed up car.

A good question would be, "Is it legal to intentionally cause an accident " ?

If a third party witnesses it , then the court will decide...They will have to prove intent...If the third party witness that has no Dog in the fight, says that you were mad,aka, Road rage, be prepared to fix your own car...

And for sure it is childish to brake check someone...That means they got under your thin skin....

From what I understand, the tailgater will cited for following too close, but the police, if they have an independent witness, can arrest you for reckless driving for Intentionally causing an accident due to road rage....

Talked to my daughter who is a cop, slamming on your brakes without reason is illegal, and if it can be proven that there was no reason to slamm the brakes, the one running into will be at no fault! Will end up in court with lots of lawyer bills for either side I guess, so not it's not worth it.

It sounds like to me if, one is tailgating and the other slams brakes, they are both at fault hence cancelling each other out. So they would be both at fault. The second ticket would be given to the tailgater. Which is also ILLEGAL! :p

Anyway fvck aggressive pickup trucks. Engine braking, no law against that. :tiphat:

What if you thought you saw a small animal out on the road and slammed on your brakes?

You can't possibly tell me that you can be held liable for something that you have no control over.

Now if you were to cut someone off because they cut you off than brake check them, the party who rear ended you will have a case. But someone can not be held liable for just slamming on their brakes and being rear ended by a tailgater.

What I said is true and you know it, the driver thought he saw something in the road and slammed on his brakes to keep themselves and their passengers safe and someone rear ended them because they were behind them at an unsafe distance, they will not and never will be at fault.

No, but depending on power/weight for his specific model, it might be close. The Z is almost certainly better geared and will have better traction.

Any cornering?

No. The truck will probably roll unless it has been substantially modified for turning and braking.

Towing?

You will lose your shirt.

So, no bets on towing capacity.

EDIT...Funny I found a few cases of Road rage where the front car slammed on its brakes to deal with a tailgater....They were charged with Murder for Killing the people in the Tailgaters car......For slamming on their brakes....Other articles the car that slammed on its brakes to back off the tailgater were charged criminally and in Civil Court with assault and got no recovery for the damage to their car....Sorry Luigi....It isn't MY opinion...This is from a Criminal and Civil Attorney who specializes in Personal Injury...

As the driver of the Z you just say you don't know anything about the guy behind you... Saw an animal run out in front of me and I hit the brakes to slow down. The tailgating dumb *** hit me; even after I had tapped my brakes once before to warn them.

....or put a video recorder in the back window and take the recording down to the local majestrate....with that kind of evidence, they usually issue a summons...its worked real nice for me in VA. It helped our majetrate take a few of these tuck fards off the road; for ever. :tup:

I have to say I hate Tailgaters and I am not one of them. Any Car especially large trucks that tailgate suck....My posts were directed at Luigi who said I was making up laws...I didn't...If an Independent witness says you purposely slammed on your brakes because you were mad, then you better have a front Camera that can prove the deer ran out, or as stated by an attorney, you will be fixing your own Car..

The Attorney states that if you purposely slam on your brakes and it was from anger, you will be the one who used your car as a weapon...This attorney has gotten convictions of assault on the front car... It is not a cut and dry case...Unless you have two cameras at the time of the accident. And no independent witness.. Ok. I agree that causing the accident is not ideal; especially in a Z.
I was simply making a point that if you articulate your response correctly, you may not look like the guy who slammed on his brakes. And perhaps the deer scenario was a poor one. Perhaps, let the tuck fard keep riding you and let up off the gas. This way if he tails you and taps your car, you could say that you were adjusting your distance between you and the car in front of you. I believe the law holds the second car accountable to adjust his/her speed to adjust to traffic. If they couldn't, then it would indicate what? That they were tailgating. Either way causing an accident is not ideal, but neither is making a conscious decision to purposely tailgate someone. As far as court goes...

In my above statement, one might be not telling the truth, but don't assume that in the real world, neither the other driver nor the po-po is going to be honest. When you go to court you have an OPPORTUNITY for justice; doesn't mean you will get it; just because you told the truth and did all the right things. Just a thought...Not recommending you cause an accident, but just recognize its in the presentation... :tiphat:

This reminds me of a story from fairly recently as I was traveling through the great state of ALLEERRBAMMMEERR (College Football capital of the world. Roll Tide and War Cam.)

I was driving one of my many performance cars in my possession. I have so many small performance cars. Some people from the south tend to think I cannot handle a large vehicle since I have so many small "zippy" cars. "Cute little toys" they were.

On this particular day, I needed gas. I stopped at this hybrid gas station/truck stop. On one side, you could gas up normal vehicles, and on the other side, you could fuel your vehicle of choice for a work truck that may or may not be used in the Mexican cartels.

I opted to prepay and go inside. There aren't very many people at this truckstop, so the two guys inside with beards, mesh-backed hats, and sleeveless flannel shirts were pointing to my Z and chuckling (the redneck chuckle that could sometimes be mistaken for a small child hyperventilating on the playground after a rough game of tag). The one that looked like he was a love child between a dude on Duck Dynasty and Larry the Cable Guy approached me first.

"I HAVE TRUCK. YOU HAVE TINY CAR. I WANT TO GO FAST. YOU WANT TO GO FAST BUT NOT FAST AS TRUCK. TINY MAN."

Thankfully, my primary occupation is that of a translator for a major consultant firm, and I specialize in 17 different languages. To my advantage, one of those languages is "retarded *** redneck". I interpreted his infantile sentence formulation as a sort of challenge to my Z with whatever truck he was driving. I quickly scrambled for a rebuttal which would satisfy his truck-driver-complex but also avoid completely eluding the peak of this man's mental capacities.

"NOPE," I replied. "YOU WIN."

Upon his realization that I could perhaps predict the future, and the future appeared to favor his wildest aspirations, he was completely stunned and speechless. I handed him a piece of beef jerky, got my gasoline, and moved on with my life.

Maybe I'm a pussy, but I wouldn't want to brake check somebody into buying me a new car even if it were legal and I'd come out ahead cost-wise. Wrecks hurt. With my luck, my replacement car if I pulled that kind of stunt would be a cripplevan with hand controls.

All in all, this comes down to Accountability. When a driver makes the decision to ignore their responsibilities it makes us want to REMIND them of it. For me, a nice discourse with a .45 barrell through their front teeth usually makes a great point, however, they usually cry and piss on themselves...but hey, I'm not recommending it...Just saying its an option....(in some countries)

For me, a nice discourse with a .45 barrell through their front teeth usually makes a great point, however, they usually cry and piss on themselves...but hey, I'm not recommending it...Just saying its an option....(in some countries)
