Pulled over for tints...while windows were down.

Got pulled over about an hour ago, my windows were down since the second I left my driveway (super hot day today).

I'm a little shocked at the cop's nerve to proceed to tell me that I have side window tint when he hasn't for one second seen even a millimeter of my window.

I was let off with a warning but god knows how hard i would have raged to get a ticket for something the cop never even saw for one second.

Wtf is this bs? That to me sounds alike to saying "Oh this is a fast sportscar. You probably speed a lot in it. Here, take this speeding ticket in advance"

:mad::shakes head:

Waiz 05-09-2013 04:45 PM

Your reputation must precede you and he must have seen you before

If you run as dark a tint as you do it's only a matter of time until you get popped

I ran the same tint as you, got popped and now run much lighter up front

Ziggyman 05-09-2013 04:47 PM

For all he knows this could be a different person, different black Z, or I could have taken off the tint last time he saw me, if he ever saw me to begin with (which is highly unlikely considering NYC). Thats number 1.

Number 2 - Probable cause dictates he would have to see me, and there would have to be a reason he "suspects" i have tint TODAY and right NOW. Not having seen a window whatsoever while my car passes there is absolutely no probable cause or reason that I would have any. Your logic is flawed. :ugh2:

EDIT: what is much lighter in your eyes? I am at 35% and its only dark in the dark. Daytime you can see through no problem.

He saw you, you got popped with a warning

Next time will be a fixit ticket, arguing about how he found about it is pretty worthless since at the end of the day you're in violation and got caught

You drive a high-profile car with limo tint, you're going to get popped again

MJB 05-09-2013 04:52 PM

Yeah at least it was just a warning OP.

No doubt i'm taking this shiit off. However its pretty ridiculous to assume there was a violation without having seen a violation. Read my example of assumption that I speed because I drive a Z. Should I be pulled over, warned, and eventually ticketed for that too? :shakes head:

1325 05-09-2013 05:08 PM

He likely based the darkness of the glass behind the side windows. LEOs need just reasonable suspicion; not necessarily sole probable cause. He probably let you off because he didn't have a tint meter to gauge your tint.

I rarely issue citations unless it's blatant--5% tint on the entire windshield, for example. :icon14:

Edit: NY's tint statute states 70% for both front and side windows maximum, with no limit on the back window. 35% is in violation by half.

JungleZ 05-09-2013 05:21 PM

Dam I only hear about this in New York, cops used to be diicks in SoCal now they don't care about no front license plate and no tint really anymore

Bking 05-09-2013 05:22 PM

Why didn't you ask him how he saw your tint?

Anyhow, he only gave you a warning for a law you violated. I'm pretty sure he could give you a ticket instead. I say today is your lucky day. Go buy lottery.

Highway 05-09-2013 05:32 PM

He would definitely have to test the windows before any ticket could be handed out. I've only had one of my cars tested and they gave me 30 days to remove it. I never did because the car came from Florida and I wasn't about to pay to have it removed. If they wanted to pay for the removal then I would have agreed. Never had issues after that.

I'm 10% below what I'm supposed to have and never had any issues so far with the Z.

Even though I hate that my own tint has to be 50/35, I still do it because it is the legal amount allowed.

This little quote kind of applies here but not completely within context so take it as it stands. When I was in the Police Academy back in 2004, a State Trooper came in and told a little story about people complaining about getting cited when an Officer didn't have his lights on or they didn't see him. His reply was simple and it shut 'em up quick. "You can't entrap an honest person." Simply put, if you are speeding, you are speeding. If you have illegal tint, you have illegal tint. How he got you for it becomes irrelevant.

Cmike2780 05-09-2013 06:25 PM

No offense, but why are you complaining or angry? You DID have illegal tints and got away with a warning. Most people are relieved when they dodge a bullet.

Oh really? How he got you becomes irrelevant? I hope i can help you brush up on your constitution and bill of rights.

Mapp v. Ohio, 367 US 643 (1961), holding "All evidence obtained by searches and seizures in violation of the Federal Constitution is inadmissible in a criminal trial in a state court."

35% is illegal in NY? :icon14:

That sucks man.

Haven't had any trouble (yet) here with my 15%, but then again when you're in a desert climate I think they tend to understand more why you need the darker tint.

PapoZalsa 05-09-2013 07:11 PM

Everything is ilegal in the Republic of VA so I dont give a crap.

NOFATCHX 05-09-2013 08:23 PM

I'm sure he figured out your side windows were tinted when he saw your rear side windows and back window.

A lot of cars these days come already with the Quarters and back windows tinted, that doesn't mean your front windows are tinted too or to the same %.

Traffic Cops that don't have anything better to do will stop you just for the hell of it. :shakes head:

Have him reason of suspicion.

Look I can't stand cops ESP when they bust your balls but ya can't really argue this. They're there to enforce rules and laws, of course were gonna love the cops that let us get away with this stuff and of course were gonna hate the ones who don't. He doesn't have to see it, just cuz your hiding your windows doesn't mean they aren't tinted and doesn't mean he can't ask to see them.

That's like saying your not breaking the law by having a brick of coke in your glove box. Just cuz he can't see it doesn't make it legal.

You can tint the back as dark as you want as long as you have side view mirrors, but sides are max 70%.

You guys do realize that its not "not that bad?" ?

70% is factory tint. And no im not talking dark tint, im talking the barely noticable green anti UV tint that every aingle car has.

In other words, absolutely zero aftermarket tint is allowed in the front

Mine came with no factory tint.

Felt like people were eyeballing me and burning holes into my head on the drive home from Vegas. :eekdance:

MyKindaGuise 05-09-2013 11:05 PM

The laws are the same here in PA and I run 20% all the way around. That's gotta suck man.

NitrousZ34 05-10-2013 12:01 AM

5% all around. Either take them off or don't complain when you get pulled over.

shooter1 05-10-2013 03:06 AM

Regardless of if he saw the tint or not, he could be checking for proper registration/licensing. Once you're stopped, your entire car is free game in order to check for compliance with your state/provinces motor vehicle act. Therefore, after asking you to roll up window and seeing tint, ticket could have been issued. Sounds like you got a break...now have a coke and a smile!

I wish that was true in my case. Got popped in Huntington Beach for a 50 on my dd. Got me for brake lights first and after I showed him a lamp that I just got ready for install, he ticketed me for the tint instead. Bought the car used and was surprised I had tints. Never noticed it for years.

Or it could be a sobriety check. 9 times out of 10 when I have to talk to a cop about my lack of a front plate, he's just checking to make sure I don't smell like booze. You got a warning, simmer down. He's just doing his job. 99% of cops are decent folks doing a really scary, crappy job.

Its gonna happen lol

I honestly find the Z looks like its tinted already because of the lack of sun roof and dark headliner. Didn't bother to tint mine

The rear quaters are super dark though, not fair to base the rest of the car on that.
