Stop giving the guy crap for going to Wal-Mart. I bet he feels like crap already enough as it is and you guys are just piling it on. We are all friends right?

Op - I actually had a similar lawsuit happen a few years back, the thing with Wal-Mart is they will try to abuse you and intimidate you, just keep your cool and keep chugging along.

Better try again on that $1K....My car was hit a month ago by trash flying out of a city truck. It only put a small dent in the bumper and I just got a check for $1,000. With paint, patch etc. he's looking at least $2000.

I suggest looking into your small claims court process. You will have a max compensation value but it may fit your case. Many success stories of the little man winning in this venue b/c the bigger company would spend more money defending the case when compared to settlement. They usually dont show up. After filing the complaint, you can even apply for summary judgement if you have all your evidence gathered and sworn statements. Consult your legal adivisor first of course. Gl.

So I went in last night after work, got the vehicle photographed and then I left. Today I called the manager of the store and he sounded surprised to hear about it and will follow up with me personally today or tomorrow.

To say every car that gets remedial maintenance at walmart will get damaged is beyond ignorant. It simply comes down to a matter of a low clearance vehicle and a steep jack ramp. I'm sure it will be handeled. it's not like walmart is running a scam terrorizing car owners. When looking for a suitable place to get an alignment, 50% of them said the can't do cars with low clearance because of the lifts ramp angle.

Yeah I learned the hard way about Walmart a few years back. Took my 323i in for a "cheaper" oil change. Left the store and a few miles later at a red light, this car pulled up to me and a guy was yelling for me to roll down my window. Once I did he said "I think your car is on fire." He then turned and drove off. I started driving again not knowing what he meant and all of a sudden a massive white cloud of smoke started pouring out from my hood. I immediately pulled over and popped the hood to find that they left a court of oil in my engine bay which melted all over my engine.

Lesson learned!

Ok, $2k. I'm not an insurance estimator my friend. Of course, a new bumper cover is only $300 from Nissan and painting is likely $500-$700 depending on where you have it done. I'm still likely wrong right? :rolleyes:

Still pointless to hire a lawyer for something like this.
