I hate to be a wet blanket, but there is a way that could be legal parking - the no parking space appears to be the access aisle for the accessible parking space to the left. If this car has handicap plates or a valid hanging tag (I am unable to determine), he is legally allowed to park in the access aisle (federal accessibility code requires that the access aisle be marked so as to discourage parking - an accessible van with the lift on the driver side might park in the access aisle and use the accessible parking space as the access aisle, giving them plenty of loading and unloading space).

The Audi R8 should be parked further back regardless who was there first. I know if I was driving a 140-150k car I would be 10 miles back.
