This might sound weird but I've found that making a stink on companies facebook pages gets them to react quickly. They use it as advertising space to convince buyers to come to their brand, and when they see someone pissed off posting on their "wall" they are usually qiuck to remedy the issue.
Also call Nissan North America customer service and voice your issue. |

Does the Berk HFC not include a heat shield or fit with the OEM heat shield?
Seems like a couple of people with non-contact thermometers could measure the Cat temps of stock and HFC?

This goes with my previous sentiments. If you need to mod it to make it fun--buy something else.
That being said, I hope they fix it for you as I doubt HFC's did it. Who knows? Technically I guess it could change the AFR which could cause increased/decreased heat or some other mumbo jumbo. More likely, though, they would argue that it changed the power of the engine, and that this caused another failure of something that interacted with the driveline. Don't dealerships get paid by Nissan for the warranty work they perform? I don't understand why any potential warranty-covered work would get declined, especially for something stupid like HFCs. I know dealerships in the Chicago area are dying for more service work. Once a customer says they wouldn't pay for work if it's not warranty covered, you'd think the dealership would backpedal and then cover the work under warranty to get the business and Nissan payment for the labor.

The dealership WANTS to do the warranty work! They get paid more for the warranty work than out of warranty work. If they ever deny the claim like in this case, it's because they fear that Nissan will learn of the aftermarket parts and deny the claim. The problem is, they can do this after the repair is made. That leaves the dealer stuck with paying for the repair that should not have been done. In short, the dealer is just looking out for themselves. In the future, if you're taking your car in for warranty work, remove ALL of your aftermarket crap before you take it in! They don't warranty aftermarket parts, they warranty factory parts. Don't believe me? Put a Spec Stage III clutch in your car and try to get your tranny replaced under warranty. ![]() |

In general, both of these statements are not true. The dealer gets paid more for non-warranty work, so they want all of their mechanics busy doing non-warranty service jobs. Dealers are reimbursed for warranty work at a reduced rate from what customers pay for non-warranty work.

Out of curiosity, doesn't Berk offer a limited warranty on parts? I would investigate and see whats there liability policy. I know stillen offers warranty on part.

The warranty is on "the" part, it does not cover collateral damage.
