The OP said he did call the cops and they filed the report. I think the issue is that the damage is less than the deductable and the insurance company

The OP said he did call the cops and they filed the report. I think the issue is that the damage is less than the deductable and the insurance company won't pursue a civil case against the other person unless the damage is above a certain dollar amount.
