Should i just drive like that home? It's a 40min drive. The trunk goes down but it just won't lock in to place.

Try to unlock it using the unlock button near the top of lic plate to unjam the lock

It shouldn't be a big deal to drive with it open, Just make sure you have the windows open so the exhaust smell can be minimized.

I've unlocked it and locked it from every possible angle. I even stuck a screw driver into the latch in hopes of locking it on its own... Nothing.. The hook things just doesn't lock.

As Trips said, it won't hurt to drive home with it like that. And you shouldn't have to remove the struts. Don't make any sudden stops. If it will make you feel better, you can run some rope between the hatch latch and one of the cargo rings in the storage area.

There is the slight possibility of carbon monoxide getting into the cabin but modern cars don't produce that much CO and rolling the windows down should keep you safe. Should; if you notice any symptoms of CO poisoning, get help immediately.
