FL is a "no fault" state, but if a police report indicates the shop (or the individual who was driving, anyway) is at fault, you can call your insurance, explain the details, and let them and the other insurance company fight it out.

If the car is totaled, when all is said and done, you should be getting a check cut to you from one of the insurance companies for a new car (however, the shop/driver should eat the deductible -- fight for that).

If the car is not totaled, look into receiving additional compensation for diminished value from the shop or driver's insurance company -- receiving compensation for that isn't law in FL, but if its a big, national company (Geico, Progressive, etc.), they will be motivated to compensate you anyway, because it is law in some state where they operate, and company policies on dealing with diminished value tend to be across the board.

Anyway, it sounds like you've endured a lot -- far more than most people can even begin to imagine enduring. Not everyone has the will to do that; you are a survivor.

This whole thing with the shop is a really, really shitty situation, and your frustration and exasperation are very understandable. But it will definitely pass, you will definitely be ok, and you will definitely have a new Z soon.

Ouch sorry to hear that OP :eek: I would recommend always watching your car whenever someone else is behind the wheel. Same thing happened to my sleeper Accord when a friend took it out for a "joyride" and ended up driving into a tree and destroying the engine bay. Then sue the shop and tell the public!

this is not possible. when i had my CSC replaced from the dealer, should i have had them call me so i could drive up there and witness the tech drive my car around the block to make sure the clutch worked?

I am at a stand still for now. Sadly....

Thank you so much for your service brother (and all the others on here that serve). It's really hard to hear your story and not want to break something. Sometimes this ******* world is so backwards and upside down that it makes you want to scream. Please update us when you can. If you get this thing up and running again, I'd like to give you my evo-r front lip painted 40th quartz. I was going to sell it (new kit), but I want you to have it more than I want the money. If you like it at all, and you end up keeping your car just say the word. I'm in Florida too and will get it to you. Stay strong bro.

Here is my exhaust video. I think m exhaust may be damaged. It is brand new. SS CUSTOMS, installed it and crashed my car. All the gaskets leak water like crazy. The driver side exit rattles like crazy and sticks out further than the passenger side . Still sounds pretty good. I need to get under it and access the damages. I've just been too busy...

Get what you deserve brother. You fought worse than this white-collar pencil pusher insurance adjuster when you were over in Afgh. Don't back down; YOU have been wronged and they need to make you WHOLE. Sending good mojo your way. Here is your new lip when my new kit comes in (should be in ~ month). a few years back someone rear-ended me in my new 2005 ford escape... i was sitting still and he hit me at 50 mph... i just made my 1st payment... long story short, the adjuster refused to total it even at the advice of the body shop manager... they had to cut the escape in half to fix it... you could literally step over the rear axle and stand behind the front seats... very bad move on the adjuster's part... i informed him and the body shop manager that i wouldn't sign-off for it until it was perfect... i made them redo it 4 times... each time costing the insurance company more and more money... by the time i accepted the repair, the costs were 27k plus 4k in rental car fees... it stickered for 28k... in a round about way, i won... and the icing on the cake was that the idiot adjuster lost his job over my claim... i work in the insurance industry... i'm an underwriter... you do NOT have to accept the repairs on your property until it's fixed to your satisfaction... and they cannot close the claim until you do... keep fighting until you're satisfied with the results op... whatever that may be for YOU

Yeah, but the problem is that you're not necessarily legally entitled to it. Emotion, pain, and suffering are not something you can recover any money from except under certain, very limited circumstances.

That's exactly what happened to me. I was pretty pissed off. I'm going to get a quote from an auto shop a full quote with parts replaced not repaired.

buddy, I did the exact same thing! took her to the dealership. their estimate was waaaaaay more than the adjusters.

im afraid your battle with this wont end well. :/

I would absolutely be there for the insurance adjuster's appraisal, and I would absolutely videotape his entire appraisal process. In the event you go to court, one of the first things you have to do is be able to negate that adjuster's appraisal. If you can provide video that shows it to be cursory, so much the better. If you are polite to him on camera and he ignores your, or better yet is rude to you, that's also to your benefit when a judge ultimately gets to see the video.

If you don't want to hold a video camera while he's appraising, rig one up in a discreet place (make sure your state is a one-party consent state).

I didn't think anyone was allowed to "fix" frame damage. That would have put me way passed pissed. Glad you got some satisfaction!

it wasn't "frame" damage... it was "unibody" damage... yepper, i was beyond pissed... and made them kiss my arse :icon23:

Update. After months of fighting with the shops insurance they finally admitted their client was at fault despite the police report already stating as such. My car was pick up from my home by a reputable shop for repairs. Now I am waiting for the insurance check to arrive which was allegedly mailed to my home address two weeks ago. I've had to reschedule training I was to attend to care to this matter. This has been a journey I hope no one else has to go through. Months of being told things were happening that have not lies being told to me insurance companies not moving my claim what so ever. Finally my cat is prepared to be fixed I will pay out of pocket if I must and file lawsuits if these things continue down this hard path.

Update. My car is still in the shop to present date. It has been a long hard battle with the shop who crashed my car insurance company. They have finally agreed to pay in full to have my car fully restore to its original condition. The repair shop says they will be finished painting her in a few more weeks. I've had to purchase a new vehicle for a daily driver because my old one died. Got a 2012 TRD FJ.

Sorry for your misfortune. A young kid who does welcome checklist for service at Nissan dealership took a joy ride of my Z! While i was told they brought it for car wash. When it came back 24 miles clocked in my odometer and the car was dirty!
I was so mad good thing nothing like this happened to my Z.

Be sure you get a check for diminished value on the Z. If you were to turn around and sell it after the repairs you wouldn't get near what it was worth before the accident. Diminished value should cover this difference.

Dam I just read this whole thread and all I can say is F***!!! At best, they did pony up the money and maybe the lack of it being driven much will yield the formalities of the repair to the point that maybe you wont notice, sounds f'd up, but i'm just trying to make light of a dark situation and hope it works out for you.
