i feel for you. small claims is a bit of a pain but not too expensive but yes it will take months. you can proceed with getting it fixed in the mean time which establishes your damages,, you don't need to wait for the settlement to get the window fixed. You get compensated for your costs if you win.
My wife had to sue her former employer for constructive dismissal so I am familiar with the process, I can PM you an outline of the process if you are interested.
