Normally NEW cars in Cali don't need a smog for the first 5 years.

If you bought the car the seller is responsible to have it smoged unless he sells it before its due, But that shouldn't be the case for you since its should be till 2015

When buying a used car you have to get it smogged regardless of the 5 year rule. And yeah, the seller SHOULD have done it, but most people don't care on such a new car
