New cars have recording devices how else do you think they check error codes and check for if something is under warranty or not.
Not on all cars but most. Some of the software to download is proprietary to the manufacturer and in some cases requires a subpoena to obtain. I work in the insurance industry and it can sometime cost us upward of $10K to download black box information after a crash. After a collision with airbag deployment 30 seconds before the collision are saved to memory and we can see everything that car was doing prior to the collision. Some manufacturers tell us that they do not monitor for warranty approval and others plead the 5th.
