Sad sad night. I was making a right turn into a Chipotle driveway when all of a sudden a (2003 Honda Accord) lady struck me from behind. She thought I was going straight and fail to notice that I was slowing down to make my turn.

The impact wasn't exactly a straight on collision. Because I was turning, the hit was angled which is why there is a major scrape.

After exchanging our papers, she called her brother and they both begged me not to go through the insurance. They said they'll cut me a check after I get a quote. The way they were begging seemed a bit suspicious for some reason.

My question is:Should I go through the insurance or have them pay out of their own pocket?

Am I in any risk?

This is my first encounter of an accident so any help/tips are appreciated.

Always go through insurance and file POLICE REPORT

F that. Go through the insurance, you never know how shady they are. they could disappear and you will be screwed. always cover your arse that way you win. Your insurance company wont raise your rates if it is not your fault. Call them up please.

I might trust them if they gave me a decent cash deposit but still take license insurance and plate info.

I had a teenager rear end my SUV once and give me a false name (always demand license and insurance card). Luckily I had a cop friend help me out and contacted the Dad who then paid me in full.

Same exact thing happened to my sister. Teenage girl rear-ended her and gave false information, but luckily we had enough information and a pretty badass cop to track her down.

I don't trust anyone enough to let them pay out of pocket. Even if it's a small scuff... unless you're going to give me more than sufficient cash on the spot we are going through insurance!

go through insurance for sure. It's also best to get the cops on the scene anytime you are in an accident so that they can have a record of everything/everyones info. I got hit by someone about a year ago and it was 100% their fault, went through insurance of course and everything was taken care of. Only thing I didn't do which I should of was called the police right then and there..It kinda held things up for me for a while but everything was taken care of in the end.

I was in the same situation they wanted to pay out of pocket, but as soon as they received the quote for repairs they tried saying it was my my fault! Go through insurance, people are shady and it's not worth your time.

Don't see any mention of a police report? Establishing facts is important after an accident, and there will be no reason for them to admit guilt without an impartial third party holding them accountable. This alone puts you at risk. The way your damage looks, they can even come back and say you cut into her lane and caused the accident.

Go through insurance. Period.

IF IF IF you must accept funds privately, make sure the repair quote is final, and that you are with a reputable shop, and that it's certified funds (cashier check). Do not accept personal check. If cash, well, make sure they aren't fake bills. At the money exchange, tie up loose end with signed documents detailing the accident and what the money is for.

Thanks guys. I really do think insurance is the way to go. I already called my insurance company. Hopefully everything gets sorted without any hiccups.

You should have filed a report, insurance might really question what happend and not want to pay...

Your insurance will require you to file a report. For that damage, get your insurance involved.

Always go through the insurance company. I don't care how much they beg, there are way to many scammers out in the world. Good luck with your Z, It could have been a lot worst.
