i didnt read all of it, but if your at some kind of court house place then the will have video of the lots. go get the video.
Same **** happened to me, I even had a police report where the guy admitted he was backed into my car but progressive is a piece of **** and said no fault and i had to pay my dedutible (he had progressive also). Even the walmart security report said he backed into me. as did my witness. but progressive again, is the biggest POS insurance company ever. In the end i paid my 500, saved myself the time and headaches and switched insurance. |
I live in one of the most historically corrupt cities unfortunately, and I have already checked everywhere near by about security cameras, and unfortunately the actual lot doesn not have any. The only place that had a camera actually set up and pointed towards the lot was police headquarters which is located right next door. Of course I go and talk to the guy in charge of that department, and he says the cameras are no longer functioning. Only in new Orleans baby. I will be getting a statement from the guy saying I did at least inquire about the camera footage.

ask your insurance company to setup a meeting withy ou and him so all 3 of you can discuss what happened n one room. he may find it harder to lie with you there. although he could always say no.
Just refuse their settlement / decision when they go no fault. |
Supposedly we are a state that doesn't allow for a no fault settlement.

So the latest from the adjuster is that he cant get in touch with the guy who hit me. I asked what happens if they never get in touch with him. He told me that I would then have to make the choice of wether I want to claim it against my own insurance or pay it out of my own pocket. How the hell does that make any sense at all? I swear insurance companies are a scam.
So guys if you ever have an accident where the police wont come out to file a report and it is your fault, just leave the scene and dont answer your phone for any strange numbers. You win! |

I know a few people that were in your situation (same exact for one of them).
It's your word against his. No matter how honest you are, and how much he lies (No one is going to openly admit that it was their fault, especially a damn lawyer). Insurance will call it a 50/50 at fault and you will either have to pay out of pocket or cover your deductible and fix the car. |
The adjuster has been calling him for a week and a half now, and he has stilled not talked to him. The guy never picks up or calls back. Kind of wierd.

How about having the adjuster sending him a written statement he has to sign for, saying he is liable and his insurance will be adjusted accordingly.
