My advice to you is to not fix the car and have insurance total the car if you haven't already done this. If you truly hit the VW doing 40 MPH your chassis will never be the same. Your car will also have major accident in its history lowering resale value. I see significant chassis damage in your pictures. I would fight insurance company and have them total the car and get a new one to replace this car.
