Thats why I would always call a cop for an accident report, If he had a rental, Im not sure what you can do at this point unless he still admits it and will do so to the police.

texasviking 04-20-2010 10:24 PM

This happened to me 3 cars ago. 6 days after delivery, I was rear ended by an 82-year-old in her 86 town car :(

Just make sure you find that sucker and that he gets fined for the false insurance info. The complex should know who is currently moving in and out to help you narrow it down.

Zaggeron 04-20-2010 10:54 PM

You should have uninsured motorist coverage on your insurance policy and, as others have suggested, you should definitely file a police report. A late report is better than none.

Cyberium 04-20-2010 11:06 PM

I think just having the Z welcomes bad luck. Whenever I drive my other cars I have no issues what so ever but on the off day that I actually decide to take it out for a spin a large rock hits my windshield or i'm stuck behind a dump truck with 4 tons of **** in the back.

Probably why it only has 4k miles on it and I've had it over a year.

pauley 04-20-2010 11:07 PM

Track him down and tell him to pay up, since he already gave you some b.s info.If that don't work then......Foot To Aaaassssss!!!!

sickest370 04-21-2010 06:46 AM

Well i did call the cops and they are the ones that did the report and got both of our info, the cop said since it happened on private property he couldnt do much, it was up to us, i have the information on the report to my insurance and they said that information wasnt from a real insurance company, i will go to the office in the complex where i live today and speak to the manager and try to get the guys information, i will also go to uhaul cuz i wrote the license plate from the truck, at least i got the guys name, if it's real. One way or another he will pay for the damage, i dont a pic to post but i will take one, the damage its not much, its the rear bumper on the driver side but he hit the corner where the bumber meets the fender.

fullmonty 04-21-2010 07:15 AM

That sucks man I hope it works out for you

DjSquall 04-21-2010 08:12 AM

Wow that guys an *** and a half. Go after him full force, and hopefully your Z will be back in shape in no time.

Azathoth 04-21-2010 09:43 AM

Whenever you have a car accident, call the police. Period. No Exception.

Watch the People's Court w/ Judge Marilyn Milian (what a Babe!), and if you can DVR all episodes, then just fast forward and watch the cases involving a car accident. You'll notice the same trend in all of them: The victim did not call the police, and that's why they're in court.

After an Accident, do NOT Move the Vehicle until the police arrive, even if you're in the middle of a lane or intersection. Just Wait. Also, carry a cheap disposable camera in your vehicle at all times. Take 2 pictures of everything (if possible) and another set of pics with your phone. Make sure to snap pics of their License Plate, The Driver, the VIN of the vehicle that hit you, far away pics, close up pics. The more pics the better.

If you're capable of moving/talking, do NOT Say anything to anyone (other than a police officer) after an accident. Immediately call the police, then call your insurance company. The legal system is designed to get people off on technicalities and you can't know them all. This is something your insurance company should have already explained to you...

I gave this 'pep talk' to all my dealership employees every quarter. Nothing is worse than having a Tech test drive a customer vehicle and get in a car accident... nothing.

Zaggeron 04-21-2010 12:12 PM

The OP said he did call the cops and they filed the report. I think the issue is that the damage is less than the deductable and the insurance company won't pursue a civil case against the other person unless the damage is above a certain dollar amount.

elmz 04-21-2010 02:18 PM

That really sucks man, I hope things work out for you. I know exactly how you feel. The same thing happened to me..1st week some dude backed into me in a big freezer truck. Except he admitted fault, but a few days later, my insurance company said that he said I hit him from behind. There was no way to prove it since I did not get any witnesses...so I ended up paying out of pocket.

wishihadnav 04-21-2010 02:24 PM

if you have uninsured motorist property damage coverage and know who this guy is then your insurance company can fix the damage WITHOUT you paying your deductible.

Zaggeron 04-21-2010 07:44 PM

The most common uninsured motorist coverage is bodily injury. My particular policy has that but doesn't have uninsured motorist property damage which would pay the deductible if you have collision coverage. Whether the insurance company will pony up depends on the OP's type of uninsured motorist coverage. The injury coverage is pretty standard, the property damage is not typically standard since for full coverage it only pays the deductible anyway

sickest370 04-22-2010 05:39 AM

I spoke to the office manager at my complex and explained to her the situation and she knows the guy that hit me, he just moved in to my complex, so he is stuck here for at least a year, she told me she couldnt give me his info by law, but i could talk to OPD or the security officer at my complex and she could give then whatever info they needed from the guy and i could get the info from them, i will try to do everything the civil way, and talk to him but if the guy wants to play gives we can do that, i will have all his info, car he drives and apartment he lives in. Even if i have to take him to civil court, i will. I have the police report and the cop told both of us he was at fault (of course my car was parked), i think the damage its more than the 500.00 deductible cuz i need a need rear bumper, rear driver side panel and a new rim.

if you get the name of the dump truck hauler or the lic number and call the company I believe they have to pay to have your window fixed. Happened to me here in ca and the company took care of it.

j.arnaldo 04-24-2010 02:06 PM
